Narrative:

Cleared by clearance delivery to sjc via gap 3 departure. ATIS advised runway 1R&left for departure. I briefed gap 3 departure: climb on heading 350 degrees to 5000 ft. Expect vectors to woodside (osi) VOR. After departing FBO, ground offered runway 28R for departure from taxiway east (6500 ft available). We completed all checklists, contacted tower, and were 'cleared for immediate takeoff, traffic 4 mi final.' as we went into position, I asked, 'confirm our heading after takeoff.' first officer said, 'left to 350 degrees.' I said, 'must be right to 350 degrees (we were on runway 28R).' first officer said, 'that's right.' at about 500 ft AGL, I started a right turn and first officer contacted sfo departure and said 'turning right to 350 degrees.' departure said, 'did tower give you that heading?' first officer said, 'we are flying the gap 3 departure.' in the meantime, I rolled out on a 310 degree heading. (Things didn't sound right to me.) departure said, 'turn left to 180 degrees, expedite through 2500 ft, climb to 5000 ft.' no other comments. TCASII indicated no conflicts. Moral: be suspicious if 2 runways (that are 90 degrees apart) have the same departure instructions. Few do, these do not! Make sure captain and first officer are in agreement on departure procedures prior to taking runway to depart.

Title: A CPR ACFT DEPARTING SFO RECEIVED A NEW RWY ASSIGNMENT AND FAILED TO FLY THE DEP AS DEPICTED. O90 TRACON ISSUED A NEW CLRNC.

Narrative: CLRED BY CLRNC DELIVERY TO SJC VIA GAP 3 DEP. ATIS ADVISED RWY 1R&L FOR DEP. I BRIEFED GAP 3 DEP: CLB ON HDG 350 DEGS TO 5000 FT. EXPECT VECTORS TO WOODSIDE (OSI) VOR. AFTER DEPARTING FBO, GND OFFERED RWY 28R FOR DEP FROM TXWY E (6500 FT AVAILABLE). WE COMPLETED ALL CHKLISTS, CONTACTED TWR, AND WERE 'CLRED FOR IMMEDIATE TKOF, TFC 4 MI FINAL.' AS WE WENT INTO POS, I ASKED, 'CONFIRM OUR HDG AFTER TKOF.' FO SAID, 'L TO 350 DEGS.' I SAID, 'MUST BE R TO 350 DEGS (WE WERE ON RWY 28R).' FO SAID, 'THAT'S RIGHT.' AT ABOUT 500 FT AGL, I STARTED A R TURN AND FO CONTACTED SFO DEP AND SAID 'TURNING R TO 350 DEGS.' DEP SAID, 'DID TWR GIVE YOU THAT HDG?' FO SAID, 'WE ARE FLYING THE GAP 3 DEP.' IN THE MEANTIME, I ROLLED OUT ON A 310 DEG HDG. (THINGS DIDN'T SOUND RIGHT TO ME.) DEP SAID, 'TURN L TO 180 DEGS, EXPEDITE THROUGH 2500 FT, CLB TO 5000 FT.' NO OTHER COMMENTS. TCASII INDICATED NO CONFLICTS. MORAL: BE SUSPICIOUS IF 2 RWYS (THAT ARE 90 DEGS APART) HAVE THE SAME DEP INSTRUCTIONS. FEW DO, THESE DO NOT! MAKE SURE CAPT AND FO ARE IN AGREEMENT ON DEP PROCS PRIOR TO TAKING RWY TO DEPART.
