Narrative:

Flight was cleared on pre departure clearance (attached) to sjc via osi at 5000 ft. The oakland five departure was not in the clearance or assigned by oakland ground or tower. On initial contact to bay departure, the captain reported 'out of 2000 ft for 5000 ft unrestr.' 5000 ft was acknowledged by a controller. Immediately, a second voice commanded a leveloff at 3000 ft and wanted to know who lifted the 2000 ft restr. Apparently he expected the flight to be on the oakland five departure as this restricts altitude to 2000 ft until the 4 DME from oakland.

Narrative: FLT WAS CLRED ON PDC (ATTACHED) TO SJC VIA OSI AT 5000 FT. THE OAKLAND FIVE DEP WAS NOT IN THE CLRNC OR ASSIGNED BY OAKLAND GND OR TWR.
