Narrative:

Autoplt on. With ZNY, cleared to FL240, climbing at approximately 2500 FPM through approximately 12000 ft, we received a TCASII TA, then RA to descend for a nebound target southwest of us at 14500 ft. Autoplt was disengaged, nose lowered, autothrottles turned off. Target aircraft was sighted (had landing light on). First officer called ZNY to say we had a TCASII RA and we were descending. They acknowledged. Target aircraft passed 700 ft above us according to TCASII display and directly overhead visually. Once clear of traffic, center reclred us to FL240. Climb was re-established and automation restored. ZNY advised us after the event that the traffic was VFR at 14500 ft and it had just been handed off to them. Center also reported that the VFR traffic had had us in sight -- they did not appear to maneuver during the event. Our ground flood lights were on. Our TCASII display was in 'above' mode. Other aircraft appeared to be a light twin propeller type. We essentially arrested our ascent rate and descended approximately 200 ft before passing the traffic and re-establishing the climb.

Title: A TWIN ENG ACR FLC RPTS THAT DURING THEIR CLB TO ALT THEY HAD TO EVADE VFR TFC LEVEL AT 14500 FT.

Narrative: AUTOPLT ON. WITH ZNY, CLRED TO FL240, CLBING AT APPROX 2500 FPM THROUGH APPROX 12000 FT, WE RECEIVED A TCASII TA, THEN RA TO DSND FOR A NEBOUND TARGET SW OF US AT 14500 FT. AUTOPLT WAS DISENGAGED, NOSE LOWERED, AUTOTHROTTLES TURNED OFF. TARGET ACFT WAS SIGHTED (HAD LNDG LIGHT ON). FO CALLED ZNY TO SAY WE HAD A TCASII RA AND WE WERE DSNDING. THEY ACKNOWLEDGED. TARGET ACFT PASSED 700 FT ABOVE US ACCORDING TO TCASII DISPLAY AND DIRECTLY OVERHEAD VISUALLY. ONCE CLR OF TFC, CTR RECLRED US TO FL240. CLB WAS RE-ESTABLISHED AND AUTOMATION RESTORED. ZNY ADVISED US AFTER THE EVENT THAT THE TFC WAS VFR AT 14500 FT AND IT HAD JUST BEEN HANDED OFF TO THEM. CTR ALSO RPTED THAT THE VFR TFC HAD HAD US IN SIGHT -- THEY DID NOT APPEAR TO MANEUVER DURING THE EVENT. OUR GND FLOOD LIGHTS WERE ON. OUR TCASII DISPLAY WAS IN 'ABOVE' MODE. OTHER ACFT APPEARED TO BE A LIGHT TWIN PROP TYPE. WE ESSENTIALLY ARRESTED OUR ASCENT RATE AND DSNDED APPROX 200 FT BEFORE PASSING THE TFC AND RE-ESTABLISHING THE CLB.
