Narrative:
During departure we were cleared to cross sjc VOR at or below 12000 ft then climb unrestr to FL230. At approximately 7 mi ZOA asked us our altitude. We responded 13000 ft. The at or above 14000 ft at 8 NM restr was not met (approximately 13400 ft at 8 NM). The controller never mentioned there was a problem and no further comments or communications were made.

Narrative: DURING DEP WE WERE CLRED TO CROSS SJC VOR AT OR BELOW 12000 FT THEN CLB UNRESTR TO FL230. AT APPROX 7 MI ZOA ASKED US OUR ALT. WE RESPONDED 13000 FT. THE AT OR ABOVE 14000 FT AT 8 NM RESTR WAS NOT MET (APPROX 13400 FT AT 8 NM). THE CTLR NEVER MENTIONED THERE WAS A PROB AND NO FURTHER COMMENTS OR COMS WERE MADE.
