Narrative:

I was northbound near empire state building along hudson river corridor at 900 ft MSL. It was between dusk and nighttime. I came up upon a PA28 at 100 ft higher, going considerably slower. I banked right and descended and passed about 350 ft under and right of him. Factors were lighting conditions, which made other plane hard to see against dark overcast sky. Also, lighting conditions made it more difficult to see his distance from me. Another factor was the relative speed difference between the 2 airplanes which resulted in my having less time to react than if the speeds were more equivalent.

Title: NMAC BTWN A CHEROKEE 6, PA32, AND A CHEROKEE ARCHER, PA28, IN LEVEL FLT AT 900 FT MSL OVER THE HUDSON RIVER OPPOSITE OF THE EMPIRE STATE BUILDING. THE RPTR IN THE CHEROKEE 6 TOOK EVASIVE ACTION TO ASSURE SEPARATION.

Narrative: I WAS NBOUND NEAR EMPIRE STATE BUILDING ALONG HUDSON RIVER CORRIDOR AT 900 FT MSL. IT WAS BTWN DUSK AND NIGHTTIME. I CAME UP UPON A PA28 AT 100 FT HIGHER, GOING CONSIDERABLY SLOWER. I BANKED R AND DSNDED AND PASSED ABOUT 350 FT UNDER AND R OF HIM. FACTORS WERE LIGHTING CONDITIONS, WHICH MADE OTHER PLANE HARD TO SEE AGAINST DARK OVCST SKY. ALSO, LIGHTING CONDITIONS MADE IT MORE DIFFICULT TO SEE HIS DISTANCE FROM ME. ANOTHER FACTOR WAS THE RELATIVE SPD DIFFERENCE BTWN THE 2 AIRPLANES WHICH RESULTED IN MY HAVING LESS TIME TO REACT THAN IF THE SPDS WERE MORE EQUIVALENT.
