Narrative:

On dec/xa/98 at approximately XA50 we were cleared for ILS runway 22 by roc approach. We were #2 with no other traffic behind us. Spacing between our aircraft and B737 was approximately 4 mi on TCASII. We were asked by roc approach to slow to 170 KTS for traffic in front of us. Since we gained another approximately 1.5 mi on air carrier, roc approach asked us again to slow further down to 150 KTS. Spacing was still too tight. At this time we were in visual contact with air carrier traffic, and the airport and runway 22. Since there was no other traffic behind us, I slowed further down to 140 KTS and 130 KTS. Then we were handed off to the tower. We called the tower and said 'roc tower on ILS 22' and tower replied, '#2 for landing one departure before you, continue.' we noticed aircraft Y approximately 500 ft from the runway 22 hold short line on taxiway C was cleared for immediate takeoff. We also noticed aircraft Y started to taxi at a very slow taxi speed. Since we were VMC and we tried very hard to communicate with the tower but he was too busy talking to aircraft Y in effort to get him to move or taxi faster due to landing traffic 'us.' at this time I had to make a decision to either go around, or do s-turns to gain time and let the tower know I was unable to reach the tower. Since I thought missed approach will put us in takeoff path and create conflict, I started 1 s-turn and aircraft Y was over the runway numbers and adding power. I had approximately 1.5 mi to the runway. I tried to explain to the tower as to why I took that kind of action. In my opinion, the tower shouldn't have cleared the air carrier Y for takeoff.

THE TWR CLRED THE B727 PRIOR TO IT REACHING THE RWY SO IT TOOK LONGER THAN THE TWR ESTIMATED FOR THE B727 TO ACTUALLY TAKE OFF AND CLR THE RWY.

WE WERE ASKED BY ROC APCH TO SLOW TO 170 KTS FOR TFC IN FRONT OF US. SINCE WE GAINED ANOTHER APPROX 1.5 MI ON ACR, ROC APCH ASKED US AGAIN TO SLOW FURTHER DOWN TO 150 KTS. SPACING WAS STILL TOO TIGHT. AT THIS TIME WE WERE IN VISUAL CONTACT WITH ACR TFC, AND THE ARPT AND RWY 22. SINCE THERE WAS NO OTHER TFC BEHIND US, I SLOWED FURTHER DOWN TO 140 KTS AND 130 KTS. THEN WE WERE HANDED OFF TO THE TWR. WE CALLED THE TWR AND SAID 'ROC TWR ON ILS 22' AND TWR REPLIED, '#2 FOR LNDG ONE DEP BEFORE YOU, CONTINUE.' WE NOTICED ACFT Y APPROX 500 FT FROM THE RWY 22 HOLD SHORT LINE ON TXWY C WAS CLRED FOR IMMEDIATE TKOF. WE ALSO NOTICED ACFT Y STARTED TO TAXI AT A VERY SLOW TAXI SPD. SINCE WE WERE VMC AND WE TRIED VERY HARD TO COMMUNICATE WITH THE TWR BUT HE WAS TOO BUSY TALKING TO ACFT Y IN EFFORT TO GET HIM TO MOVE OR TAXI FASTER DUE TO LNDG TFC 'US.' AT THIS TIME I HAD TO MAKE A DECISION TO EITHER GO AROUND, OR DO S-TURNS TO GAIN TIME AND LET THE TWR KNOW I WAS UNABLE TO REACH THE TWR. SINCE I THOUGHT MISSED APCH WILL PUT US IN TKOF PATH AND CREATE CONFLICT, I STARTED 1 S-TURN AND ACFT Y WAS OVER THE RWY NUMBERS AND ADDING PWR. I HAD APPROX 1.5 MI TO THE RWY. I TRIED TO EXPLAIN TO THE TWR AS TO WHY I TOOK THAT KIND OF ACTION. IN MY OPINION, THE TWR SHOULDN'T HAVE CLRED THE ACR Y FOR TKOF.
