Narrative:

Departing ontario, ca, for kansas city. We were given the pom 6 departure to climb to 14000 ft. After takeoff we were turned over to departure. The controller advised us to comply with the restrs of the SID. The SID says to cross pom VOR at or below 8000 ft. We were climbing through 9000 ft when the controller caught it. We leveled at 9000 ft and no traffic was issued. I believe that if the clearance delivery had told us to comply with the SID and had not given us the altitude of 14000 ft, we would have seen the restr of 8000 ft at pom.

Title: FLC OF A CESSNA CITATION II C550 OVERSHOT SID XING FIX ALT DURING DEP RESULTING IN ATC INTERVENTION TO STOP THEIR CLB ANY FURTHER. THEY BELIEVED THAT EVEN THOUGH THEY WERE CLRED ON A SID DEP THAT THE INTERMEDIATE ALT FIXES WERE NO LONGER APPLICABLE DURING CLRNC TO A HIGHER ALT GIVEN BY CLRNC DELIVERY.

Narrative: DEPARTING ONTARIO, CA, FOR KANSAS CITY. WE WERE GIVEN THE POM 6 DEP TO CLB TO 14000 FT. AFTER TKOF WE WERE TURNED OVER TO DEP. THE CTLR ADVISED US TO COMPLY WITH THE RESTRS OF THE SID. THE SID SAYS TO CROSS POM VOR AT OR BELOW 8000 FT. WE WERE CLBING THROUGH 9000 FT WHEN THE CTLR CAUGHT IT. WE LEVELED AT 9000 FT AND NO TFC WAS ISSUED. I BELIEVE THAT IF THE CLRNC DELIVERY HAD TOLD US TO COMPLY WITH THE SID AND HAD NOT GIVEN US THE ALT OF 14000 FT, WE WOULD HAVE SEEN THE RESTR OF 8000 FT AT POM.
