Narrative:

I departed jra at XA35, en route to hto with 2 passenger. Routing was VFR and planned a route north on the hudson river in the class B exclusion 1100 ft or below and upon obtaining a lga class B clearance, central park, overhead lga, throgs neck bridge, direct hto. My copilot was monitoring lga radar to make the class B clearance request and I was monitoring 123.05, the exclusion advisory frequency. Both frequencys were congested during our climb to 1100 ft. At XA38 I was level at 1100 ft and put my attention to the lga class B frequency and lga was busy with a cessna 'xx.' the conversation that I recall was, lga: 'xx there's traffic at your 12 O'clock position, 1100 ft northbound.' xx: searching? Lga: 'xx you'll have to circle until you have the traffic.' xx: 'ok, I have the traffic.' lga: 'xx you are cleared central park, overhead throgs neck bridge...' at AB39, a C210X crossed left to right, 200-300 ft in front of me at exactly the same altitude I was at. This was just as lga was issuing the class B clearance to 'xx.' I did not make any evasive maneuvers as there wasn't time. Within 1 or 2 seconds the traffic visible as a threat and then clear. Seeing and avoiding traffic is a 2-WAY street and once a pilot sees another aircraft, right of way rules of the road apply. This doesn't always work. The ny city area is unique with 3 class B facilities and exclusions. There should be holding points charted for use by pilots and controllers in conjunction with specific rtes. There are helicopter routes and perhaps these should be expanded to other aircraft.

SEEING AND AVOIDING TFC IS A 2-WAY STREET AND ONCE A PLT SEES ANOTHER ACFT, RIGHT OF WAY RULES OF THE ROAD APPLY. THIS DOESN'T ALWAYS WORK. THE NY CITY AREA IS UNIQUE WITH 3 CLASS B FACILITIES AND EXCLUSIONS. THERE SHOULD BE HOLDING POINTS CHARTED FOR USE BY PLTS AND CTLRS IN CONJUNCTION WITH SPECIFIC RTES. THERE ARE HELI ROUTES AND PERHAPS THESE SHOULD BE EXPANDED TO OTHER ACFT.
