Flight crew of a B727 were asked, by an ARTCC radar controller, if they were going to make an altitude crossing restr. Flight crew answered that they were never given a restr when being cleared to the altitude to which they were climbing.

Narrative:

Climbing to FL330. All of a sudden ATC asks if we will meet altitude restr (level FL330, 115 NM southeast mem). We were never given any altitude restr. We are positive about that. ATC says we were. They are wrong. ATC turned us. We passed other aircraft 1000 ft and about 8 mi laterally.

Narrative: CLBING TO FL330. ALL OF A SUDDEN ATC ASKS IF WE WILL MEET ALT RESTR (LEVEL FL330, 115 NM SE MEM). WE WERE NEVER GIVEN ANY ALT RESTR. WE ARE POSITIVE ABOUT THAT. ATC SAYS WE WERE. THEY ARE WRONG. ATC TURNED US. WE PASSED OTHER ACFT 1000 FT AND ABOUT 8 MI LATERALLY.
