Narrative:

During a northwest visual river departure to join 328 degree right dca VOR climbing to 5000 ft, switched over to departure control and were cleared to 9000 ft. Copilot pointed out traffic at 1 O'clock above closing right to left. Passing 4800 ft ATC called 'maintain 5000 ft.' TCASII TA target appeared at 1 O'clock. A pushover with 30 degree right bank toward rear of the target (visual) resulted in a 250 ft overshoot and return to 5000 ft as traffic passed in front of us approximately 2 1/2 mi. I estimate our vertical speed at 2000 plus ft at the time of contact sighting. We did not get a TCASII rr. The other aircraft was at 6000 ft under positive control with instructions to maintain a visual on us. This was determined later by phone to ATC, and that our controller had forgotten about the 6000 ft traffic when he cleared us to 9000 ft and remembered and call to stop us at 5000 ft. The controller was very busy and seemed to be behind.

Title: ALTDEV ALT OVERSHOT - FLC WAS INITIALLY GIVEN A HIGHER ALT ON CLBOUT, BUT AT THE LAST MOMENT THE DEP CTLR REMEMBERED THAT HE HAD CLRED ANOTHER ACFT THROUGH THE SAME AIRSPACE AT THE SAME TIME. THE CTLR CALLED FOR AN INSTANT LEVELOFF AND THE FLC OVERSHOT, BUT REMAINED CLR OF THE OTHER ACFT.

I ESTIMATE OUR VERT SPD AT 2000 PLUS FT AT THE TIME OF CONTACT SIGHTING. WE DID NOT GET A TCASII RR. THE OTHER ACFT WAS AT 6000 FT UNDER POSITIVE CTL WITH INSTRUCTIONS TO MAINTAIN A VISUAL ON US. THIS WAS DETERMINED LATER BY PHONE TO ATC, AND THAT OUR CTLR HAD FORGOTTEN ABOUT THE 6000 FT TFC WHEN HE CLRED US TO 9000 FT AND REMEMBERED AND CALL TO STOP US AT 5000 FT. THE CTLR WAS VERY BUSY AND SEEMED TO BE BEHIND.
