Narrative:

On departure from sjc following the loope 9 SID, we had been cleared to 12000 ft and to the VOR. The SID specified to cross the VOR at 12000 ft. 3 mi from the VOR inbound, we were cleared to FL230 and the copilot set FL230 in the altitude alerter. We crossed the VOR climbing through 14000 ft when the controller asked us to verify altitude, and commented that we should have crossed at 12000 ft. We both believed the last clearance to FL230 had canceled the 12000 ft crossing restr.

Narrative: ON DEP FROM SJC FOLLOWING THE LOOPE 9 SID, WE HAD BEEN CLRED TO 12000 FT AND TO THE VOR. THE SID SPECIFIED TO CROSS THE VOR AT 12000 FT. 3 MI FROM THE VOR INBOUND, WE WERE CLRED TO FL230 AND THE COPLT SET FL230 IN THE ALT ALERTER. WE CROSSED THE VOR CLBING THROUGH 14000 FT WHEN THE CTLR ASKED US TO VERIFY ALT, AND COMMENTED THAT WE SHOULD HAVE CROSSED AT 12000 FT. WE BOTH BELIEVED THE LAST CLRNC TO FL230 HAD CANCELED THE 12000 FT XING RESTR.
