Narrative:

Near vetmo intersection while cruising at FL390, received a TA followed by an RA after a 10 second delay. Port-au-prince control informed us of the traffic while TCASII was issuing the TA alert. Target was visually acquired -- made easier from contrails, and was displayed on EFIS screen. Traffic was an opposite direction challenger jet climbing from FL370- 410. When first displayed as a TA on EFIS, (target) altitude was FL389 and climbing -- however climb rate observed was slow. After TCASII RA alert was sounded, the first officer, who was PF the legs, maneuvered our aircraft in accordance to TCASII instructions. A descent of 300 ft was executed. During our descent challenger jet's rate of climb appeared to increase and when it passed above us its TCASII altitude was above FL400. We were turned over to ZMA shortly after the RA and informed center of the RA and descent.

Title: FLC OF A B757 DSNDED IN RESPONSE TO A TCASII RA AND THE VISUAL SIGHTING OF A CANADAIR CHALLENGER CLBING UP THROUGH THEIR ALT TO A HIGHER ALT, RESULTING IN LESS THAN LEGAL SEPARATION.

Narrative: NEAR VETMO INTXN WHILE CRUISING AT FL390, RECEIVED A TA FOLLOWED BY AN RA AFTER A 10 SECOND DELAY. PORT-AU-PRINCE CTL INFORMED US OF THE TFC WHILE TCASII WAS ISSUING THE TA ALERT. TARGET WAS VISUALLY ACQUIRED -- MADE EASIER FROM CONTRAILS, AND WAS DISPLAYED ON EFIS SCREEN. TFC WAS AN OPPOSITE DIRECTION CHALLENGER JET CLBING FROM FL370- 410. WHEN FIRST DISPLAYED AS A TA ON EFIS, (TARGET) ALT WAS FL389 AND CLBING -- HOWEVER CLB RATE OBSERVED WAS SLOW. AFTER TCASII RA ALERT WAS SOUNDED, THE FO, WHO WAS PF THE LEGS, MANEUVERED OUR ACFT IN ACCORDANCE TO TCASII INSTRUCTIONS. A DSCNT OF 300 FT WAS EXECUTED. DURING OUR DSCNT CHALLENGER JET'S RATE OF CLB APPEARED TO INCREASE AND WHEN IT PASSED ABOVE US ITS TCASII ALT WAS ABOVE FL400. WE WERE TURNED OVER TO ZMA SHORTLY AFTER THE RA AND INFORMED CTR OF THE RA AND DSCNT.
