Narrative:

Departing teb in a C3. Cleared for immediate takeoff, line up checks completed and TCASII is turned on. Tower does not advise us of a VFR C150 overhead and flying in the takeoff direction (runway 1). The teb 3 departure requires a 40 degree heading while climbing to 2000 ft. Noise abatement climb for teb is V2+10. On climb out, RA was issued by the TCASII to stop climb and then monitor vertical speed. We complied, and told the tower that we were leveling off. The new rate of climb actually caused us to blow through the C150's altitude. The tower controller was upset that we leveled off and stated that since the other aircraft was VFR, we didn't need to follow the RA. (We did not see the traffic.) he also told us that he didn't have to advise us of the traffic. When the TCASII presented the conflict, even on the 3 mi scale, the red RA box was right next to the aircraft symbol. Only god prevented the midair. If only we were told about the traffic crossing overhead teb before we started our takeoff roll would have prevented this whole thing. We were operating at a light gross weight, so the climb performance was outstanding, but the idea of being chided for following the TCASII as trained, is unbelievable. Anyways, no more noise abatement climbs at V2+10 at teb for us.

ONLY GOD PREVENTED THE MIDAIR. IF ONLY WE WERE TOLD ABOUT THE TFC XING OVERHEAD TEB BEFORE WE STARTED OUR TKOF ROLL WOULD HAVE PREVENTED THIS WHOLE THING. WE WERE OPERATING AT A LIGHT GROSS WT, SO THE CLB PERFORMANCE WAS OUTSTANDING, BUT THE IDEA OF BEING CHIDED FOR FOLLOWING THE TCASII AS TRAINED, IS UNBELIEVABLE. ANYWAYS, NO MORE NOISE ABATEMENT CLBS AT V2+10 AT TEB FOR US.
