Narrative:

Cleared to cross tammy at 10000 ft, 25 mi from tammy at FL240. Advised unable. Controller asked why and what we were planning. I said unable tammy at 10000 ft. Controller ignored us and asked a second time what we had been planning. I told him unable tammy at 10000 ft. Controller never released or gave us a new restr. We crossed tammy at 12500 ft. After I had told controller twice that we were unable to cross tammy at 10000 ft I asked for a new clearance and the controller said stand by, and he never came back with a different crossing restr.
