In sum: prior to landing at 3n8, a CE500 crew announced to clt TRACON that they would be dropping off passenger, then refiling IFR to gso. After takeoff, the same controller told the rptrs to maintain VFR, but did not ever give an IFR clearance. The rptrs had IFR traffic on their TCASII. Clt TRACON asked if the rptrs were climbing in the clt class B airspace. The rptrs replied in the affirmative and climbed out of the class B and were advised to call clt upon arrival. Clt announced, on the telephone, that the rptrs had been in the clt class B airspace without an IFR clearance and that other traffic had had to make deviations because of TCASII alerts. The rptrs claim a misunderstanding miscom with clt TRACON. They thought that they had been given clearance into the class B airspace.

Title: A CE500 CREW CLBED INTO THE CLT CLASS B AIRSPACE WITHOUT CLRNC. FLC AND TRACON CTLR TECHNIQUE COM. THE FLC HEARD WHAT THEY WANTED TO HEAR AND DID NOT WAIT FOR CLRNC.

Narrative: IN SUM: PRIOR TO LNDG AT 3N8, A CE500 CREW ANNOUNCED TO CLT TRACON THAT THEY WOULD BE DROPPING OFF PAX, THEN REFILING IFR TO GSO. AFTER TKOF, THE SAME CTLR TOLD THE RPTRS TO MAINTAIN VFR, BUT DID NOT EVER GIVE AN IFR CLRNC. THE RPTRS HAD IFR TFC ON THEIR TCASII. CLT TRACON ASKED IF THE RPTRS WERE CLBING IN THE CLT CLASS B AIRSPACE. THE RPTRS REPLIED IN THE AFFIRMATIVE AND CLBED OUT OF THE CLASS B AND WERE ADVISED TO CALL CLT UPON ARR. CLT ANNOUNCED, ON THE TELEPHONE, THAT THE RPTRS HAD BEEN IN THE CLT CLASS B AIRSPACE WITHOUT AN IFR CLRNC AND THAT OTHER TFC HAD HAD TO MAKE DEVS BECAUSE OF TCASII ALERTS. THE RPTRS CLAIM A MISUNDERSTANDING MISCOM WITH CLT TRACON. THEY THOUGHT THAT THEY HAD BEEN GIVEN CLRNC INTO THE CLASS B AIRSPACE.
