Narrative:

Being vectored for spacing, given clear to climb from our altitude of FL270. Thought new altitude given was FL330 (filed altitude). Read back FL330 and inserted in fmp. During climb in turn to assigned heading, controller asked what altitude we were climbing to and I answered FL330. He said we were given FL280. Got TA on TCASII as we passed about 4 NM behind other aircraft that was at FL290. Called ATC from lga and talked to supervisor. He said he had listened to tape and said we were given FL280 but read back FL330 and controller did not catch the incorrect readback. First officer also thought FL330 was given to us as we confirmed altitude as per company policy. Lots of chatter on frequency. Could have heard another aircraft stepping on ATC and therefore misheard the correct altitude.

Narrative: BEING VECTORED FOR SPACING, GIVEN CLR TO CLB FROM OUR ALT OF FL270. THOUGHT NEW ALT GIVEN WAS FL330 (FILED ALT). READ BACK FL330 AND INSERTED IN FMP. DURING CLB IN TURN TO ASSIGNED HDG, CTLR ASKED WHAT ALT WE WERE CLBING TO AND I ANSWERED FL330. HE SAID WE WERE GIVEN FL280. GOT TA ON TCASII AS WE PASSED ABOUT 4 NM BEHIND OTHER ACFT THAT WAS AT FL290. CALLED ATC FROM LGA AND TALKED TO SUPVR. HE SAID HE HAD LISTENED TO TAPE AND SAID WE WERE GIVEN FL280 BUT READ BACK FL330 AND CTLR DID NOT CATCH THE INCORRECT READBACK. FO ALSO THOUGHT FL330 WAS GIVEN TO US AS WE CONFIRMED ALT AS PER COMPANY POLICY. LOTS OF CHATTER ON FREQ. COULD HAVE HEARD ANOTHER ACFT STEPPING ON ATC AND THEREFORE MISHEARD THE CORRECT ALT.
