Narrative:

Normal freight feeder operation. Departed oaj evening of mar/thu/96 at XA00 and noted ILS OTS but NDB facilities ok. Normal flight to rdu. Following morning one of my associated pilots got WX briefing for all 3 of our rtes (rdu-oaj, rdu-ewn, rdu-mqi) and stated that WX was approximately 600 ft and 5 mi over the whole area. Picked up my canned flight plan and departed for oaj at XB11 am. Seymour controller cleared me down to 3000 ft from 9000 ft at approximately XB45. I checked AWOS 600 ft and 5 mi and prepared for NDB approach. On handoff to ilm, new controller stated, ILS localizer and DME and NDB OTS but all I heard was ILS, localizer and DME -- this must be what I wanted to hear! The NDB was identing and appeared to be operating perfectly! The controller cleared me to 2100 ft and asked my intentions. I asked for the NDB approach and he then stated it was listed as OTS. I asked him to confirm and he checked with raleigh and confirmed it was notamed OTS, and he then cleared me for the approach. I said 'unable to accept the clearance' and requested a hold at the marker -- all evidence was that it was working perfectly. He gave me the hold. I flew the published hold while I contacted my company for instructions and then made an uneventful flight to iso. In retrospect, I also cannot remember if the holding instructions were for left or right turns, but I flew it as published and nobody said anything (I made approximately 6 turns). I was feeling ill and rather tired that morning, but I will always check NOTAMS in future, and be more aware of what ATC says to me in the air!

I SAID 'UNABLE TO ACCEPT THE CLRNC' AND REQUESTED A HOLD AT THE MARKER -- ALL EVIDENCE WAS THAT IT WAS WORKING PERFECTLY. HE GAVE ME THE HOLD. I FLEW THE PUBLISHED HOLD WHILE I CONTACTED MY COMPANY FOR INSTRUCTIONS AND THEN MADE AN UNEVENTFUL FLT TO ISO. IN RETROSPECT, I ALSO CANNOT REMEMBER IF THE HOLDING INSTRUCTIONS WERE FOR L OR R TURNS, BUT I FLEW IT AS PUBLISHED AND NOBODY SAID ANYTHING (I MADE APPROX 6 TURNS). I WAS FEELING ILL AND RATHER TIRED THAT MORNING, BUT I WILL ALWAYS CHK NOTAMS IN FUTURE, AND BE MORE AWARE OF WHAT ATC SAYS TO ME IN THE AIR!
