Narrative:

Given TA by ny departure (120.55) at XA25 local out of 5000 ft MSL. We were given a heading to avoid traffic (commuter airline flying north up the hudson river at 5500 ft MSL). Commuter said he had us in sight. We received TCASII TA followed by RA. Followed TCASII to avoid traffic. Commuter aircraft made no attempt to avoid us. Passed within 80 ft vertical and 750 ft horizontal.
