Narrative:

We had filed an IFR flight plan from ali, direct scy, scy 7, direct dal. As we were unable to contact kingsville approach on the ground at alice and the WX was reported and appeared to be VFR, we departed VFR on runway 35. Unfortunately we had to level at 2000 ft MSL for a cloud layer just north of alice. Just prior to reaching the edge of the cloud layer and the ability to continue the VFR climb, we passed by orange grove nalf (nog) at a distance of approximately 3 NM at 2000 ft MSL. Approximately 30 seconds after passing nog the cloud cover dissipated and we continued our VFR climb. We made several attempts during this time to contact kingsville approach for IFR clearance to no avail. Clearance was finally received from ZHU. A telephone call to the kingsville approach confirmed there was no traffic or conflict at the time and that, in fact, the tower personnel did not see us. Lesson learned should be to check the charts thoroughly to make sure no other airspace is close in the event departure plans change after takeoff.

Title: FLC OF AN LTT CPR JET TOOK OFF VFR AND INADVERTENTLY PENETRATED CLASS D AIRSPACE OF A NEARBY ARPT.

Narrative: WE HAD FILED AN IFR FLT PLAN FROM ALI, DIRECT SCY, SCY 7, DIRECT DAL. AS WE WERE UNABLE TO CONTACT KINGSVILLE APCH ON THE GND AT ALICE AND THE WX WAS RPTED AND APPEARED TO BE VFR, WE DEPARTED VFR ON RWY 35. UNFORTUNATELY WE HAD TO LEVEL AT 2000 FT MSL FOR A CLOUD LAYER JUST N OF ALICE. JUST PRIOR TO REACHING THE EDGE OF THE CLOUD LAYER AND THE ABILITY TO CONTINUE THE VFR CLB, WE PASSED BY ORANGE GROVE NALF (NOG) AT A DISTANCE OF APPROX 3 NM AT 2000 FT MSL. APPROX 30 SECONDS AFTER PASSING NOG THE CLOUD COVER DISSIPATED AND WE CONTINUED OUR VFR CLB. WE MADE SEVERAL ATTEMPTS DURING THIS TIME TO CONTACT KINGSVILLE APCH FOR IFR CLRNC TO NO AVAIL. CLRNC WAS FINALLY RECEIVED FROM ZHU. A TELEPHONE CALL TO THE KINGSVILLE APCH CONFIRMED THERE WAS NO TFC OR CONFLICT AT THE TIME AND THAT, IN FACT, THE TWR PERSONNEL DID NOT SEE US. LESSON LEARNED SHOULD BE TO CHK THE CHARTS THOROUGHLY TO MAKE SURE NO OTHER AIRSPACE IS CLOSE IN THE EVENT DEP PLANS CHANGE AFTER TKOF.
