Narrative:

During SID, tower deleted 5000 ft restr to climb and cleared us to FL230. I heard 'cross sjc VOR at or above 12000 ft, maintain FL230. First officer thinks he heard cross VOR at 12000 ft, maintain FL230. We crossed sjc VOR climbing through 13000 ft. Oakland questioned whether departure had deleted altitude restrs. I told them what I had heard. Supplemental information from acn 313220: early morning departure from sjc. Cleared via loop 9 departure (overly complicated with several altitude restrs). Controller cleared us to turn to sjc VOR fly published SID climb to FL230 and I thought I heard cross sjc at 12000 ft. FL230 was set in altitude window. While performing collateral duties I looked and saw we were climbing through 13100 ft just prior to crossing sjc. I questioned the 12000 ft restr to captain who said he heard sjc at or above 12000 ft. When 2 altitude clrncs are received it would probably be best to put the most restrictive in the altitude window. This is my company's SOP, but in the confused clearance the 'cleared to' altitude was set. No traffic conflict resulted.
