Narrative:

I previously reported this incident where I used 'poor judgement in continuing flight to mobile. Although the rest of the trip's WX was VMC, because I'd had dizziness during IMC takeoff, that eventually led to my grounding myself when I returned to mobile and have been since feb/xx/95. The reason for this report is I have gone to several sources including far's, flight instructors, and AME's and can find no mechanism or regulation that requires an airman who is grounded to report being disabled to the FAA directly. I have reported it to my AME and his understanding is that as long as I don't fly and reapply for my medical when and if I get better, before I attempt to fly and of course disclose the condition on that reapplication, I am violating no far's. Since I grounded myself when I became aware of my medical problem that fulfills the spirit of the regulations. If I am incorrect please advise as this is unintentional violation. I am enclosing a copy of my mar/xx/95 pm 39 report to mr X reply. I just don't know any procedure to report this. If you bring it to the FAA's attention: voluntarily they will find a way to 'gig' you. Callback conversation with reporter revealed the following information: reporter stated that he continued to have some discomfort and reoccurrences during walking and driving a vehicle so that he had not reapplied for renewal of his first class medical which will expire in jan of 1996 to a second class status. However, he did find out from an AME that he would need current tests in order to determine his true medical status prior to consideration of his airmen's medical renewal! He was the chief pilot for a corporation operating a falcon 20 type aircraft.

Title: PLT OF A CPR JET GNDS HIMSELF AFTER EXPERIENCED DIZZINESS DURING DEP IN IFR CONDITIONS.

Narrative: I PREVIOUSLY RPTED THIS INCIDENT WHERE I USED 'POOR JUDGEMENT IN CONTINUING FLT TO MOBILE. THE REASON FOR THIS RPT IS I HAVE GONE TO SEVERAL SOURCES INCLUDING FAR'S, FLT INSTRUCTORS, AND AME'S AND CAN FIND NO MECHANISM OR REG THAT REQUIRES AN AIRMAN WHO IS GNDED TO RPT BEING DISABLED TO THE FAA DIRECTLY. I HAVE RPTED IT TO MY AME AND HIS UNDERSTANDING IS THAT AS LONG AS I DON'T FLY AND REAPPLY FOR MY MEDICAL WHEN AND IF I GET BETTER, BEFORE I ATTEMPT TO FLY AND OF COURSE DISCLOSE THE CONDITION ON THAT REAPPLICATION, I AM VIOLATING NO FAR'S. SINCE I GNDED MYSELF WHEN I BECAME AWARE OF MY MEDICAL PROB THAT FULFILLS THE SPIRIT OF THE REGS. IF I AM INCORRECT PLEASE ADVISE AS THIS IS UNINTENTIONAL VIOLATION. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATED THAT HE CONTINUED TO HAVE SOME DISCOMFORT AND REOCCURRENCES DURING WALKING AND DRIVING A VEHICLE SO THAT HE HAD NOT REAPPLIED FOR RENEWAL OF HIS FIRST CLASS MEDICAL WHICH WILL EXPIRE IN JAN OF 1996 TO A SECOND CLASS STATUS. HOWEVER, HE DID FIND OUT FROM AN AME THAT HE WOULD NEED CURRENT TESTS IN ORDER TO DETERMINE HIS TRUE MEDICAL STATUS PRIOR TO CONSIDERATION OF HIS AIRMEN'S MEDICAL RENEWAL! HE WAS THE CHIEF PLT FOR A CORPORATION OPERATING A FALCON 20 TYPE ACFT.
