Narrative:

The problem I am reporting is the fact that we landed on a runway (19L at mci) certified for CAT I ILS approachs (1/2 mi, 2400 RVR) when the WX was reported 1/8 mi fog and RVR 1200 ft on runway 19R. When approaching mci we got the ATIS and found the WX to be no problem. As we got closer we were advised by approach control (who was also working tower and ground control due to the time of day) that the WX was 1/8 mi fog and on runway 19R the touchdown zone RVR was 1200 ft. The controller initially tried to vector us for runway 1R, I believe. This is not a CAT ii runway, so we requested runway 19R which is. If we would have landed on runway 19R this would have been legal and no problem. While being vectored to runway 19R, on several occasions the controller brought to our attention the lack of fog on runway 19L. As we approached from the north we came to the same conclusion. All the fog was over on runway 19R and runway 19L was clear. At the time it seemed silly to land on the runway with all the fog. (Except for the patchy ground fog it was a very clear night). The captain asked me to tell the controller we would take a visual to runway 19L. I did this and the controller cleared us for the ILS runway 19L and cleared to land. We landed without incident on runway 19L. Looking back I do not believe this was legal. There was no RVR reporting equipment on runway 19L.

WHEN APCHING MCI WE GOT THE ATIS AND FOUND THE WX TO BE NO PROB. AS WE GOT CLOSER WE WERE ADVISED BY APCH CTL (WHO WAS ALSO WORKING TWR AND GND CTL DUE TO THE TIME OF DAY) THAT THE WX WAS 1/8 MI FOG AND ON RWY 19R THE TOUCHDOWN ZONE RVR WAS 1200 FT. THE CTLR INITIALLY TRIED TO VECTOR US FOR RWY 1R, I BELIEVE. THIS IS NOT A CAT II RWY, SO WE REQUESTED RWY 19R WHICH IS. IF WE WOULD HAVE LANDED ON RWY 19R THIS WOULD HAVE BEEN LEGAL AND NO PROB. WHILE BEING VECTORED TO RWY 19R, ON SEVERAL OCCASIONS THE CTLR BROUGHT TO OUR ATTN THE LACK OF FOG ON RWY 19L. AS WE APCHED FROM THE N WE CAME TO THE SAME CONCLUSION. ALL THE FOG WAS OVER ON RWY 19R AND RWY 19L WAS CLR. AT THE TIME IT SEEMED SILLY TO LAND ON THE RWY WITH ALL THE FOG. (EXCEPT FOR THE PATCHY GND FOG IT WAS A VERY CLR NIGHT). THE CAPT ASKED ME TO TELL THE CTLR WE WOULD TAKE A VISUAL TO RWY 19L. I DID THIS AND THE CTLR CLRED US FOR THE ILS RWY 19L AND CLRED TO LAND. WE LANDED WITHOUT INCIDENT ON RWY 19L. LOOKING BACK I DO NOT BELIEVE THIS WAS LEGAL. THERE WAS NO RVR RPTING EQUIP ON RWY 19L.
