Narrative:

We were on a scheduled flight from mia to pid. We were cleared to descend to 1500 ft by NAS approach. At about 2200 ft NAS told us to maintain 2000 ft which we did. Another aircraft, a light twin was climbing up out of NAS and they told him to maintain (I think) 1500 ft which he didn't, he leveled at 2000 ft our altitude. NAS 2 times told him to descend right away he did not react. By this time we were closing fast on this aircraft and our TCASII commanded us to descend, descend! We did right away at 1500 FPM and told NAS what we were doing, they said no maintain 2000 ft we said no we have an alert (TCASII) and we must comply. We were able to see the other aircraft during this and I feel if we did not descend when we did there was a good chance we would have been within ft of the other aircraft or worse. The controller understood what we did and why but if he had let us keep descending and the other aircraft kept climbing there would not have been a conflict. It was fairly busy at NAS approach and I think he just lost track of the twin for a min and then his reaction was to level both of us to sort it out, but once he did that, that's when the trouble started. We had the FAA on jumpseat doing a line check he said we did well and was impressed with how well the TCASII worked. Supplemental information from acn 298699: our aircraft was cleared to 1500 ft and reclred to 2000 ft out of 2200 ft. We maintained 2000 ft. ATC called traffic 1 O'clock 2 mi 2000 ft. Traffic was in sight. Approach/ATC told other aircraft to descend to 1500 ft. Other aircraft did not respond. TCASII alert on our aircraft 'traffic.' 'traffic,' descend, descend, descend now. PF descended, PNF told ATC we were in descent to avoid traffic. We descended to 1000 ft. Approach must not have foreseen converging traffic.

Title: ACR X TCASII RA DSND WITH ACFT Y NON ADHERENCE TO ATC INSTRUCTION. EVASIVE ACTION TAKEN, SEE AND AVOID CONCEPT.

ANOTHER ACFT, A LIGHT TWIN WAS CLBING UP OUT OF NAS AND THEY TOLD HIM TO MAINTAIN (I THINK) 1500 FT WHICH HE DIDN'T, HE LEVELED AT 2000 FT OUR ALT. NAS 2 TIMES TOLD HIM TO DSND RIGHT AWAY HE DID NOT REACT. BY THIS TIME WE WERE CLOSING FAST ON THIS ACFT AND OUR TCASII COMMANDED US TO DSND, DSND! WE DID RIGHT AWAY AT 1500 FPM AND TOLD NAS WHAT WE WERE DOING, THEY SAID NO MAINTAIN 2000 FT WE SAID NO WE HAVE AN ALERT (TCASII) AND WE MUST COMPLY. WE WERE ABLE TO SEE THE OTHER ACFT DURING THIS AND I FEEL IF WE DID NOT DSND WHEN WE DID THERE WAS A GOOD CHANCE WE WOULD HAVE BEEN WITHIN FT OF THE OTHER ACFT OR WORSE. THE CTLR UNDERSTOOD WHAT WE DID AND WHY BUT IF HE HAD LET US KEEP DSNDING AND THE OTHER ACFT KEPT CLBING THERE WOULD NOT HAVE BEEN A CONFLICT. IT WAS FAIRLY BUSY AT NAS APCH AND I THINK HE JUST LOST TRACK OF THE TWIN FOR A MIN AND THEN HIS REACTION WAS TO LEVEL BOTH OF US TO SORT IT OUT, BUT ONCE HE DID THAT, THAT'S WHEN THE TROUBLE STARTED. WE HAD THE FAA ON JUMPSEAT DOING A LINE CHK HE SAID WE DID WELL AND WAS IMPRESSED WITH HOW WELL THE TCASII WORKED. SUPPLEMENTAL INFO FROM ACN 298699: OUR ACFT WAS CLRED TO 1500 FT AND RECLRED TO 2000 FT OUT OF 2200 FT. WE MAINTAINED 2000 FT. ATC CALLED TFC 1 O'CLOCK 2 MI 2000 FT. TFC WAS IN SIGHT. APCH/ATC TOLD OTHER ACFT TO DSND TO 1500 FT. OTHER ACFT DID NOT RESPOND. TCASII ALERT ON OUR ACFT 'TFC.' 'TFC,' DSND, DSND, DSND NOW. PF DSNDED, PNF TOLD ATC WE WERE IN DSCNT TO AVOID TFC. WE DSNDED TO 1000 FT. APCH MUST NOT HAVE FORESEEN CONVERGING TFC.
