Narrative:

We were cleared from eze to scl at FL280. Mendoza control had then cleared us to FL260, and we were level at FL260, when the TCASII sounded with the following, 'descend-descend,' and we complied with that. The TCASII showed an airplane at about 1-2 O'clock, 2-3 mi away, at FL260, also. We were in visual contact with the airplane when we deviated. Mendoza control did not answer when we called, so we immediately called santiago approach on 119.7 and told them we had traffic at the same altitude. The other airplane was foreign air carrier, who had started out of eze after us and had been at FL350 until he descended down to our altitude at umkal intersection. We did see him come closer and closer, visually, and the TCASII showed the same thing up until the TCASII sent the message to descend. Title: WHILE IN FOREIGN AIRSPACE, AN ACR RESPONDED TO A TCASII, WHICH OCCURRED WITH REACHING LESS THAN APPLICABLE SEPARATION MINIMA.

Narrative: WE WERE CLRED FROM EZE TO SCL AT FL280. MENDOZA CTL HAD THEN CLRED US TO FL260, AND WE WERE LEVEL AT FL260, WHEN THE TCASII SOUNDED WITH THE FOLLOWING, 'DSND-DSND,' AND WE COMPLIED WITH THAT. THE TCASII SHOWED AN AIRPLANE AT ABOUT 1-2 O'CLOCK, 2-3 MI AWAY, AT FL260, ALSO. WE WERE IN VISUAL CONTACT WITH THE AIRPLANE WHEN WE DEVIATED. MENDOZA CTL DID NOT ANSWER WHEN WE CALLED, SO WE IMMEDIATELY CALLED SANTIAGO APCH ON 119.7 AND TOLD THEM WE HAD TFC AT THE SAME ALT. THE OTHER AIRPLANE WAS FOREIGN ACR, WHO HAD STARTED OUT OF EZE AFTER US AND HAD BEEN AT FL350 UNTIL HE DSNDED DOWN TO OUR ALT AT UMKAL INTXN. WE DID SEE HIM COME CLOSER AND CLOSER, VISUALLY, AND THE TCASII SHOWED THE SAME THING UP UNTIL THE TCASII SENT THE MESSAGE TO DSND.
