Narrative:

On oct/xx/94 a stemme S-10 self launching glider called for taxi. Previously the pilot of the glider cut out a pwred aircraft with a student on a solo flight while the pwred aircraft was on short final. Refused to comply with an ATC instruction to remain outside our class D airspace, and declared an emergency to afford priority sequencing and treatment for no other reason than the pilot did not want to restart his engine before landing at our airport. Due to the preceding reasons, I asked the pilot if he would comply with ATC instructions to restart his engine before entering our class D airspace if requested by the controller. The pilot responded that he would not and he would reenter the airspace as a glider. I then refused to issue taxi instructions and informed the pilot that I could not approve unrestr glider operations at that time. The pilot taxied the aircraft back to parking and called the tower. When the pilot called he explained that the stemme S-10 was a self launching glider and he was entitled to depart as a motorized aircraft and return as a glider. I informed him that I had asked him on at least 2 other occasions to restart his engine before entering our airspace and he complied. He informed me that he had never restarted his engine prior to entering our airspace and was not going to do it. I then said that this would be settled by FSDO but, until I was told otherwise, I would not allow unrestr glider operations at the airport while I was controller in charge.

Title: COMPLIANCE WITH ATC INSTRUCTIONS.

Narrative: ON OCT/XX/94 A STEMME S-10 SELF LAUNCHING GLIDER CALLED FOR TAXI. PREVIOUSLY THE PLT OF THE GLIDER CUT OUT A PWRED ACFT WITH A STUDENT ON A SOLO FLT WHILE THE PWRED ACFT WAS ON SHORT FINAL. DUE TO THE PRECEDING REASONS, I ASKED THE PLT IF HE WOULD COMPLY WITH ATC INSTRUCTIONS TO RESTART HIS ENG BEFORE ENTERING OUR CLASS D AIRSPACE IF REQUESTED BY THE CTLR. THE PLT RESPONDED THAT HE WOULD NOT AND HE WOULD REENTER THE AIRSPACE AS A GLIDER. I THEN REFUSED TO ISSUE TAXI INSTRUCTIONS AND INFORMED THE PLT THAT I COULD NOT APPROVE UNRESTR GLIDER OPS AT THAT TIME. THE PLT TAXIED THE ACFT BACK TO PARKING AND CALLED THE TWR. I INFORMED HIM THAT I HAD ASKED HIM ON AT LEAST 2 OTHER OCCASIONS TO RESTART HIS ENG BEFORE ENTERING OUR AIRSPACE AND HE COMPLIED. HE INFORMED ME THAT HE HAD NEVER RESTARTED HIS ENG PRIOR TO ENTERING OUR AIRSPACE AND WAS NOT GOING TO DO IT. I THEN SAID THAT THIS WOULD BE SETTLED BY FSDO BUT, UNTIL I WAS TOLD OTHERWISE, I WOULD NOT ALLOW UNRESTR GLIDER OPS AT THE ARPT WHILE I WAS CTLR IN CHARGE.
