Narrative:

Airline has extremely well-defined procedures for avoiding mountain wave phenomenon. On this flight we were flying a mountain wave deviation route. In the vicinity of abq, NM, ATC attempted to give us a route clearance which would have penetrated the cim mountain wave area which was code red (must avoid) at the time. As an accommodation to ATC, we informed them that we could deviate 5 mi north of course. They stated that this was adequate and gave us a 5 mi north offset clearance. Shortly thereafter, ZAB insisted we must accept a route clearance which would enter the cim mountain wave area. We were forced by air carrier X procedures to refuse the ATC route clearance and were informed that a pilot violation would be filed.

Title: FLC OF AN LGT ACR ACFT REFUSED ROUTING FROM ATC AT HIGH ALT CRUISE DUE TO MOUNTAIN WAVE WARNING.

Narrative: AIRLINE HAS EXTREMELY WELL-DEFINED PROCS FOR AVOIDING MOUNTAIN WAVE PHENOMENON. ON THIS FLT WE WERE FLYING A MOUNTAIN WAVE DEV RTE. IN THE VICINITY OF ABQ, NM, ATC ATTEMPTED TO GIVE US A RTE CLRNC WHICH WOULD HAVE PENETRATED THE CIM MOUNTAIN WAVE AREA WHICH WAS CODE RED (MUST AVOID) AT THE TIME. AS AN ACCOMMODATION TO ATC, WE INFORMED THEM THAT WE COULD DEVIATE 5 MI N OF COURSE. THEY STATED THAT THIS WAS ADEQUATE AND GAVE US A 5 MI N OFFSET CLRNC. SHORTLY THEREAFTER, ZAB INSISTED WE MUST ACCEPT A RTE CLRNC WHICH WOULD ENTER THE CIM MOUNTAIN WAVE AREA. WE WERE FORCED BY ACR X PROCS TO REFUSE THE ATC RTE CLRNC AND WERE INFORMED THAT A PLT VIOLATION WOULD BE FILED.
