Narrative:

Departing iad on assigned heading 140 degrees at 10000 ft, TCASII advised TA of approaching aircraft about 10 NM ahead, 900 ft below our altitude and climbing. Washington departure frequency 126.55 was busy -- not getting a word in. TCASII gave an RA and we commenced evasive maneuver/climb as directed by TCASII and immediately advised washington departure at first opportunity of our actions. Shortly thereafter we gained visual on small twin which passed off our left side and low. Washington departure cleared us to continue climb to FL190. We were at 10700 ft starting down when we received that clearance. ATC was extremely busy and controller was not prepared for our actions as it seemed to take him by surprise.

Title: FLC OF ACR MLG ACFT TOOK EVASIVE ACTION IN RESPONSE TO A TCASII RA RESULTING IN AN EXCURSION FROM ASSIGNED ALT.

Narrative: DEPARTING IAD ON ASSIGNED HDG 140 DEGS AT 10000 FT, TCASII ADVISED TA OF APCHING ACFT ABOUT 10 NM AHEAD, 900 FT BELOW OUR ALT AND CLBING. WASHINGTON DEP FREQ 126.55 WAS BUSY -- NOT GETTING A WORD IN. TCASII GAVE AN RA AND WE COMMENCED EVASIVE MANEUVER/CLB AS DIRECTED BY TCASII AND IMMEDIATELY ADVISED WASHINGTON DEP AT FIRST OPPORTUNITY OF OUR ACTIONS. SHORTLY THEREAFTER WE GAINED VISUAL ON SMALL TWIN WHICH PASSED OFF OUR L SIDE AND LOW. WASHINGTON DEP CLRED US TO CONTINUE CLB TO FL190. WE WERE AT 10700 FT STARTING DOWN WHEN WE RECEIVED THAT CLRNC. ATC WAS EXTREMELY BUSY AND CTLR WAS NOT PREPARED FOR OUR ACTIONS AS IT SEEMED TO TAKE HIM BY SURPRISE.
