Narrative:

After having the flap switches worked on by maintenance we got a 'flaps' takeoff warning before takeoff (in checklist). The captain visually confirmed the flap position and declared it safe to takeoff. After an uneventful takeoff, once at cruise altitude, he checked the MEL and realized that we should have had the warning fixed. The decision was not made to willfully disregard the safety. Rather, was made in haste in the #1 takeoff position with other aircraft waiting. Prevention: take the time to check the books out even if it causes inconvenience. Make sure what you're doing is 'legal,' as well as safe.

Title: CAPT OF LGT ACR ACFT DISREGARDED AN ACFT WARNING SYS PROB AND TKOF IN NON COMPLIANCE TO THE ACFT 'MEL' PROVISIONS.

Narrative: AFTER HAVING THE FLAP SWITCHES WORKED ON BY MAINT WE GOT A 'FLAPS' TKOF WARNING BEFORE TKOF (IN CHKLIST). THE CAPT VISUALLY CONFIRMED THE FLAP POS AND DECLARED IT SAFE TO TKOF. AFTER AN UNEVENTFUL TKOF, ONCE AT CRUISE ALT, HE CHKED THE MEL AND REALIZED THAT WE SHOULD HAVE HAD THE WARNING FIXED. THE DECISION WAS NOT MADE TO WILLFULLY DISREGARD THE SAFETY. RATHER, WAS MADE IN HASTE IN THE #1 TKOF POS WITH OTHER ACFT WAITING. PREVENTION: TAKE THE TIME TO CHK THE BOOKS OUT EVEN IF IT CAUSES INCONVENIENCE. MAKE SURE WHAT YOU'RE DOING IS 'LEGAL,' AS WELL AS SAFE.
