Narrative:

Approximately 40 mi southwest of onm at FL260, air carrier X asked for higher and were cleared to FL330 to be level in 5 mins. The pre departure clearance's estimated the time-to-climb at 5 mins. At 5 mins, 12 seconds into the climb, we were not yet level at FL330 and the captain requested a turn for the remainder of the climb. The controller gave us a turn and also turned the conflicting traffic (level at FL310). According to ATC, we came too close for their separation limits and issued a possible pilot deviation.

Title: ACR X NON ADHERENCE TO ATC CLRNC FAILED TO MEET ALT CLB RESTRICTION HAD LTSS FROM Y. PLTDEV.

Narrative: APPROX 40 MI SW OF ONM AT FL260, ACR X ASKED FOR HIGHER AND WERE CLRED TO FL330 TO BE LEVEL IN 5 MINS. THE PDC'S ESTIMATED THE TIME-TO-CLB AT 5 MINS. AT 5 MINS, 12 SECONDS INTO THE CLB, WE WERE NOT YET LEVEL AT FL330 AND THE CAPT REQUESTED A TURN FOR THE REMAINDER OF THE CLB. THE CTLR GAVE US A TURN AND ALSO TURNED THE CONFLICTING TFC (LEVEL AT FL310). ACCORDING TO ATC, WE CAME TOO CLOSE FOR THEIR SEPARATION LIMITS AND ISSUED A POSSIBLE PLTDEV.
