Narrative:

We were tracking inbound sjc on the runway 30L localizer level at 5000 ft MSL, in solid IFR flight conditions. Bay approach advised us of non radio (small transport twin jet aircraft) traffic also at 5000 ft. We advised approach we were IFR and requested vector off course to avoid conflict. Approach control was very slow to issue clearance to avoid traffic which then required evasive maneuver after TCASII alert.
