Narrative:

Air carrier X upon departing logan airport we were given instructions to fly runway heading and cleared for takeoff. Traffic was heavy and we were fit in between landing aircraft. Upon being cleared into position, we were told to be ready for an immediate takeoff. Controller attention was divided between the landing aircraft's turn off intersection, the aircraft's distance to the runway that was on short final approach and our aircraft. After takeoff we began a climb to 5000 ft, the SID altitude and told to contact departure. We made contact with departure control where we reported leaving 2000 ft for 5000 ft. Roger was the response. After leaving 4000 ft we were told by departure to maintain 3000 ft due to traffic. By this time it was too late to descend which was realized by departure control. We were subsequently told to continue the climb. Departure control stated that the tower should have assigned us 3000 ft due to traffic. We did not see the conflicting traffic nor were told how close that we came to this traffic. Unfortunately, our aircraft was not equipped with TCASII.

Narrative: ACR X UPON DEPARTING LOGAN ARPT WE WERE GIVEN INSTRUCTIONS TO FLY RWY HDG AND CLRED FOR TKOF. TFC WAS HVY AND WE WERE FIT IN BTWN LNDG ACFT. UPON BEING CLRED INTO POS, WE WERE TOLD TO BE READY FOR AN IMMEDIATE TKOF. CTLR ATTN WAS DIVIDED BTWN THE LNDG ACFT'S TURN OFF INTXN, THE ACFT'S DISTANCE TO THE RWY THAT WAS ON SHORT FINAL APCH AND OUR ACFT. AFTER TKOF WE BEGAN A CLB TO 5000 FT, THE SID ALT AND TOLD TO CONTACT DEP. WE MADE CONTACT WITH DEP CTL WHERE WE RPTED LEAVING 2000 FT FOR 5000 FT. ROGER WAS THE RESPONSE. AFTER LEAVING 4000 FT WE WERE TOLD BY DEP TO MAINTAIN 3000 FT DUE TO TFC. BY THIS TIME IT WAS TOO LATE TO DSND WHICH WAS REALIZED BY DEP CTL. WE WERE SUBSEQUENTLY TOLD TO CONTINUE THE CLB. DEP CTL STATED THAT THE TWR SHOULD HAVE ASSIGNED US 3000 FT DUE TO TFC. WE DID NOT SEE THE CONFLICTING TFC NOR WERE TOLD HOW CLOSE THAT WE CAME TO THIS TFC. UNFORTUNATELY, OUR ACFT WAS NOT EQUIPPED WITH TCASII.
