Narrative:

While in level cruise at FL290 in IMC approximately 130 DME out on the 290 degree radial of alb, TCASII issued a TA for a wbound aircraft level at FL280 at 11-12 O'clock. At approximately 124 DME TCASII issued an RA for same aircraft target, requested a climb of approximately 1500 FPM. The RA was followed and aircraft was maneuvered up to 29600 ft when a 'clear of conflict' advisory was issued. ATC was advised and we were instructed to descend to FL290 and they confirmed that the wbound aircraft had remained at FL280. It was our belief that TCASII was faulty, therefore, it was turned off and deferred as inoperative by maintenance.

ATC WAS ADVISED AND WE WERE INSTRUCTED TO DSND TO FL290 AND THEY CONFIRMED THAT THE WBOUND ACFT HAD REMAINED AT FL280. IT WAS OUR BELIEF THAT TCASII WAS FAULTY, THEREFORE, IT WAS TURNED OFF AND DEFERRED AS INOP BY MAINT.
