Narrative:

Level 4000 heading 060 degrees radar vectored to a position normally above the teb VORTAC, 10 mi final to runway 22L at newark airport. TCASII indicated potential conflict, right wing tip, 4 mi, same altitude, between our position and airport. 'Reduce 210 (speed), right turn to 120 degrees, descend to 3000 ft.' following clearance, shortly after initiating descending turn, 'traffic' announcement came on TCASII voice, following shortly by 'climb, climb.' from around 3800 ft the climb took aircraft to approximately 4300-4350 level immediately following end of traffic conflict advisory statement by TCASII. Aircraft was promptly put back in descending turn while PNF advised ATC of altitude excursion due to a TCASII RA. The controller, in a rather surprising fashion, immediately launched into a dramatical outburst about the advisability of such maneuver. He went on into considerations about 6000 ft traffic conflict! And lack of conflicting aircraft into our flight path. Captain explained our maneuver was executing in accordance with TCASII procedures. ATC said they would file report. Captain followed up on the telephone. First officer flying the approach. Incident left crew wondering why our strict adherence to evasive maneuver instructed by TCASII with in fact the target clearly on the screen, would provoke such reaction from controller.

FROM AROUND 3800 FT THE CLB TOOK ACFT TO APPROX 4300-4350 LEVEL IMMEDIATELY FOLLOWING END OF TFC CONFLICT ADVISORY STATEMENT BY TCASII. ACFT WAS PROMPTLY PUT BACK IN DSNDING TURN WHILE PNF ADVISED ATC OF ALT EXCURSION DUE TO A TCASII RA. THE CTLR, IN A RATHER SURPRISING FASHION, IMMEDIATELY LAUNCHED INTO A DRAMATICAL OUTBURST ABOUT THE ADVISABILITY OF SUCH MANEUVER. HE WENT ON INTO CONSIDERATIONS ABOUT 6000 FT TFC CONFLICT! AND LACK OF CONFLICTING ACFT INTO OUR FLT PATH. CAPT EXPLAINED OUR MANEUVER WAS EXECUTING IN ACCORDANCE WITH TCASII PROCS. ATC SAID THEY WOULD FILE RPT. CAPT FOLLOWED UP ON THE TELEPHONE. FO FLYING THE APCH. INCIDENT LEFT CREW WONDERING WHY OUR STRICT ADHERENCE TO EVASIVE MANEUVER INSTRUCTED BY TCASII WITH IN FACT THE TARGET CLRLY ON THE SCREEN, WOULD PROVOKE SUCH REACTION FROM CTLR.
