Narrative:

We were level at 4000 ft when departure asked if we had traffic in sight at 9:30 to 10 O'clock. We said we had that traffic, which was an light transport turbo. We were then cleared to 6000 ft maintain visual separation. On our climb the light transport Y said that he had to deviate from his altitude because we were too close. We had him in sight at all times and when he went under us we were out of 5700 ft. I guess close for some people is too close for others. There was never any time when we thought the airplanes were close enough for evasive action.

Title: POTENTIAL CONFLICT THAT WOULD HAVE BEEN A NMAC HAD IT NOT BEEN FOR THE EVASIVE ACTION DIVE TAKEN BY PIC OF ACR Y.

Narrative: WE WERE LEVEL AT 4000 FT WHEN DEP ASKED IF WE HAD TFC IN SIGHT AT 9:30 TO 10 O'CLOCK. WE SAID WE HAD THAT TFC, WHICH WAS AN LTT TURBO. WE WERE THEN CLRED TO 6000 FT MAINTAIN VISUAL SEPARATION. ON OUR CLB THE LTT Y SAID THAT HE HAD TO DEVIATE FROM HIS ALT BECAUSE WE WERE TOO CLOSE. WE HAD HIM IN SIGHT AT ALL TIMES AND WHEN HE WENT UNDER US WE WERE OUT OF 5700 FT. I GUESS CLOSE FOR SOME PEOPLE IS TOO CLOSE FOR OTHERS. THERE WAS NEVER ANY TIME WHEN WE THOUGHT THE AIRPLANES WERE CLOSE ENOUGH FOR EVASIVE ACTION.
