Narrative:

Ground, cleared to push, taxi to 8R via 20-P hold short of 8L, contact tower holding short of 8L. Pushed off gate at XA00 PST. Holding short of 8L, tower advises air carrier X holding short of 8R they will follow us. Tower tells us to cross 8L into position 8R and hold. As we start to cross 8L we notice that the air carrier X aircraft has pulled up too far on S-23 to clear him. We advise the tower, tower instructs us to taxi down 8L into position and hold. Note: we are now using a different runway for departure and holding in position, awaiting departures off of 8R. Tower advises cleared for takeoff, also the tower gives a clearance to maintain 3000. We ask the tower if the 3000 was for us and tower said no, that's for another aircraft, maintain 14000. Note: takeoff is now on 8L, original clearance and departure predicated on 8R. Maintain 14000. Newly assigned altitude, deletes all others, FARS. Unrestricted to 14000 at this time. Takeoff completed at XX17 PST, tower advises contact departure, right turn to 255 as soon as practicable. Turn started at 500 ft AGL. Contacted departure, 125.5 departure, radar contact, proceed direct to pom. We are now going direct to pom. We are now taken off of the SID (255 heading, intercept the pom 114R). This direct clearance to pom further reinforces our thoughts of unrestricted climb to 14000. As usual, great work between tower and departure to expedite traffic, due to the delays. Departure control, contact lax center. After contact is made with lax center, we are asked by the controller if we had an altitude restriction over pom? We replied, last altitude received, maintain 14000, direct pom. We ask if there was a problem, and center controller stated he had no problem, ont departure had inquired about the 8000 restriction over pom. Lax center controller states, climb to 14000. There were no conflicts. Departure cleared us direct pom. He is watching the departure gate and climb. If the controller saw a potential altitude problem coming up, why did he not advise as we were fast approaching the 8000 ft level? A suggestion that may help prevent altitude conflicts in the future: when clearance delivery is issuing a clearance, the first altitude restriction on the SID should be the altitude to maintain, not an altitude after the first restriction. This information passed to the tower.

WE ASK THE TWR IF THE 3000 WAS FOR US AND TWR SAID NO, THAT'S FOR ANOTHER ACFT, MAINTAIN 14000. NOTE: TKOF IS NOW ON 8L, ORIGINAL CLRNC AND DEP PREDICATED ON 8R. MAINTAIN 14000. NEWLY ASSIGNED ALT, DELETES ALL OTHERS, FARS. UNRESTRICTED TO 14000 AT THIS TIME. TKOF COMPLETED AT XX17 PST, TWR ADVISES CONTACT DEP, R TURN TO 255 AS SOON AS PRACTICABLE. WE ASK IF THERE WAS A PROBLEM, AND CENTER CTLR STATED HE HAD NO PROBLEM, ONT DEP HAD INQUIRED ABOUT THE 8000 RESTRICTION OVER POM. LAX CENTER CTLR STATES, CLB TO 14000. THERE WERE NO CONFLICTS. DEP CLRED US DIRECT POM. HE IS WATCHING THE DEP GATE AND CLB. IF THE CTLR SAW A POTENTIAL ALT PROBLEM COMING UP, WHY DID HE NOT ADVISE AS WE WERE FAST APCHING THE 8000 FT LEVEL? A SUGGESTION THAT MAY HELP PREVENT ALT CONFLICTS IN THE FUTURE: WHEN CLRNC DELIVERY IS ISSUING A CLRNC, THE FIRST ALT RESTRICTION ON THE SID SHOULD BE THE ALT TO MAINTAIN, NOT AN ALT AFTER THE FIRST RESTRICTION.
