Narrative:

Arriving at lby VOR for VOR approach to hbg airport. Copilot calls traffic at 3 O'clock and starts to take evasive action. No action was taken. An small transport passes behind and below our aircraft. The small transport had us in his 12 O'clock position. Houston center terminates radar service about this same time because they were unable to maintain radar with us. The traffic was not observed by controller or no communication established. Since no tail # was known no report was filed with FAA. For conditions flying 3000 ft by traffic, would also be legal. Also contributing was min VFR conditions at flight altitude.

THE TFC WAS NOT OBSERVED BY CTLR OR NO COM ESTABLISHED. SINCE NO TAIL # WAS KNOWN NO RPT WAS FILED WITH FAA. FOR CONDITIONS FLYING 3000 FT BY TFC, WOULD ALSO BE LEGAL. ALSO CONTRIBUTING WAS MIN VFR CONDITIONS AT FLT ALT.
