Narrative:

TCAS aircraft was in level flight with autoplt on. TCAS issued instructions to climb. Climb was initiated as required by standard FAA procedures. TCAS warning was for a departure out of dfw that was reported by ATC to be level 1000' below us. We feel the alert was unnecessary as both aircraft has standard sep for the terminal area. The required altitude deviation placed us in greater danger. Pilot has no option to evaluate a known situation as FAA procedures mandate pilot evasive action. TCAS warnings in terminal areas are excessive. The software needs refining badly before it causes an accident, or the FAA should allow the pilots judgement to override a TCAS warning or command. Supplemental information from acn 181584: warning was for a dfw departure climbing/leveling 1000' below our altitude and was in sight.

Title: ACR MLG ALT DEVIATION EXCURSION FROM CLRNC ALT IN RESPONSE TO TCASII RA. TRAFFIC WAS IN SIGHT.

Narrative: TCAS ACFT WAS IN LEVEL FLT WITH AUTOPLT ON. TCAS ISSUED INSTRUCTIONS TO CLB. CLB WAS INITIATED AS REQUIRED BY STANDARD FAA PROCS. TCAS WARNING WAS FOR A DEP OUT OF DFW THAT WAS RPTED BY ATC TO BE LEVEL 1000' BELOW US. WE FEEL THE ALERT WAS UNNECESSARY AS BOTH ACFT HAS STANDARD SEP FOR THE TERMINAL AREA. THE REQUIRED ALT DEVIATION PLACED US IN GREATER DANGER. PLT HAS NO OPTION TO EVALUATE A KNOWN SITUATION AS FAA PROCS MANDATE PLT EVASIVE ACTION. TCAS WARNINGS IN TERMINAL AREAS ARE EXCESSIVE. THE SOFTWARE NEEDS REFINING BADLY BEFORE IT CAUSES AN ACCIDENT, OR THE FAA SHOULD ALLOW THE PLTS JUDGEMENT TO OVERRIDE A TCAS WARNING OR COMMAND.
