Narrative:

We were cleared to cross fuzzy intersection at 16000'. I asked the captain 3 times if he was planning to make the restriction. He said yes. At 10 mi prior to fuzzy I started to advise center, but the captain said no. We were 2000' high at fuzzy. Shortly before fuzzy the captain turned of the mode C. Approach requested our altitude twice and advised that our mode C was inoperative. I think the captain could use communication CRM and change his attitude.

Title: CAPT MISSES CROSSING RESTRICTION, TURNS MODE C OFF.

Narrative: WE WERE CLRED TO CROSS FUZZY INTXN AT 16000'. I ASKED THE CAPT 3 TIMES IF HE WAS PLANNING TO MAKE THE RESTRICTION. HE SAID YES. AT 10 MI PRIOR TO FUZZY I STARTED TO ADVISE CTR, BUT THE CAPT SAID NO. WE WERE 2000' HIGH AT FUZZY. SHORTLY BEFORE FUZZY THE CAPT TURNED OF THE MODE C. APCH REQUESTED OUR ALT TWICE AND ADVISED THAT OUR MODE C WAS INOP. I THINK THE CAPT COULD USE COM CRM AND CHANGE HIS ATTITUDE.
