Narrative:

Doing a maintenance functional check flight on a filed IFR from efd to vuh, a VFR delay of 20 mins out over the gulf to do the airwork required by the fcf, and an IFR pickup from scholes back to efd. I cancelled IFR with departure control and requested traffic advisories and flight following, departure control kept me on the same IFF code. I departed vuh on the 140 degree right at 10500'. I went to 15 NM to ensure I was outside the continental control area, and climbed to FL350 to complete the engine acceleration checks. As I was returning to ellington, I was informed that I was being violated for climbing above FL230 prior to being given permission.
