Narrative:

I was the pilot of small aircraft X on the morning of may, 1991. Prior to takeoff contact with ft worth center was attempted. It was not yet xx:00Z so the control tower was not yet open and the control zone not yet in effect. I made a radio call on the CTAF stating that I was departing on runway 22. Upon leaving ground contact was established with ft worth center. A clearance to shreveport was received before entering the overcast layer at 800' MSL. The center controller advised us that texarkana tower had reported to him a possible violation of controled airspace. It was my feeling that no far's would be compromised by my actions on that morning. As I stated the possible violation occurred before xx:00Z (approximately 5 mins before xx:oo). The south center USA airport facility directory states that the control zone is in effect from xx:ooz to Y:00Z. If a clearance had been received on the ground the whole situation could have been avoided. If texarkana had an rco to ft worth center located on the field it would eliminate the problem of unreliable communications with center. Supplemental information from acn 178188. Since the control tower was not open at this time the pilot could not receive a clearance via radio communication. With no conflict with controled airspace, the pilot departed and upon breaking ground contacted center for his IFR clearance to shreveport regional airport. A clearance was received before encountering the overcast layer at 800' MSL. Ft worth center issued a clearance and informed the pilot that he had violated controled airspace. The controller stated that the WX at texarkana was 500' ceiling and 3 mi visibility and that the control zone was in effect so a clearance to depart was required before takeoff. However, according to the airport-facility directory the control zone is not in effect until xx:00 zulu. Later, the center controller informed the pilot that texarkana tower was reporting him for possible violation of far 91.

Narrative: I WAS THE PLT OF SMA X ON THE MORNING OF MAY, 1991. PRIOR TO TKOF CONTACT WITH FT WORTH CTR WAS ATTEMPTED. UPON LEAVING GND CONTACT WAS ESTABLISHED WITH FT WORTH CTR. A CLRNC TO SHREVEPORT WAS RECEIVED BEFORE ENTERING THE OVCST LAYER AT 800' MSL. THE CTR CTLR ADVISED US THAT TEXARKANA TWR HAD RPTED TO HIM A POSSIBLE VIOLATION OF CTLED AIRSPACE. IT WAS MY FEELING THAT NO FAR'S WOULD BE COMPROMISED BY MY ACTIONS ON THAT MORNING. AS I STATED THE POSSIBLE VIOLATION OCCURRED BEFORE XX:00Z (APPROX 5 MINS BEFORE XX:OO). THE S CTR USA ARPT FAC DIRECTORY STATES THAT THE CTL ZONE IS IN EFFECT FROM XX:OOZ TO Y:00Z. IF A CLRNC HAD BEEN RECEIVED ON THE GND THE WHOLE SITUATION COULD HAVE BEEN AVOIDED. IF TEXARKANA HAD AN RCO TO FT WORTH CTR LOCATED ON THE FIELD IT WOULD ELIMINATE THE PROB OF UNRELIABLE COMS WITH CTR. SUPPLEMENTAL INFO FROM ACN 178188. I WAS A PAX IN SMA X, THE MORNING IT DEPARTED TEXARKANA ARPT RWY 22. CONTACT WITH FT WORTH CTR WAS ATTEMPTED BEFORE TKOF AT THE END OF THE RWY. SINCE THE CTL TWR WAS NOT OPEN AT THIS TIME THE PLT COULD NOT RECEIVE A CLRNC VIA RADIO COM. WITH NO CONFLICT WITH CTLED AIRSPACE, THE PLT DEPARTED AND UPON BREAKING GND CONTACTED CTR FOR HIS IFR CLRNC TO SHREVEPORT REGIONAL ARPT. A CLRNC WAS RECEIVED BEFORE ENCOUNTERING THE OVCST LAYER AT 800' MSL. FT WORTH CTR ISSUED A CLRNC AND INFORMED THE PLT THAT HE HAD VIOLATED CTLED AIRSPACE. THE CTLR STATED THAT THE WX AT TEXARKANA WAS 500' CEILING AND 3 MI VISIBILITY AND THAT THE CTL ZONE WAS IN EFFECT SO A CLRNC TO DEPART WAS REQUIRED BEFORE TKOF. HOWEVER, ACCORDING TO THE ARPT-FAC DIRECTORY THE CTL ZONE IS NOT IN EFFECT UNTIL XX:00 ZULU. LATER, THE CTR CTLR INFORMED THE PLT THAT TEXARKANA TWR WAS RPTING HIM FOR POSSIBLE VIOLATION OF FAR 91.
