Narrative:

Cleared as filed to jfk. Flight plan on board read ric V16 pxi V229 panze camrn 2 STAR jfk. After takeoff we were assigned various headings and altitudes. The final instructions we received and acknowledged from ric departure was to fly an 050 degree heading to intercept the ric 074 degree right. Shortly after that, we were told to contact ZDC. After contact I told the captain that the course we were on would take us into the rappa and delmar MOA's. Captain then asked controller, 'what's the plan for us?' the controller responded he would have higher for us as soon as possible. (We were lower than normal at this point, but we were concerned about the MOA's that were hot 1 hour ago). Shortly after that the controller noticed we were in the R4006 and instructed us to turn 40 degrees left to join V33 as assigned. The captain told the controller that we had never been issued that clearance. The controller's initial vector was inadequate to join the arwy. We spent several extra mins in a hot MOA while everything was sorted out. Contributing factors: poor communication is the #1 cause here. The clearance was given 'as filed.' this is an unacceptable practice, especially in high density areas or in close proximity to hot areas. The clearance delivery person may have had our old flight plan of ric 074 degree right model V33 colin, etc, in front of him. We have no way of knowing which route he had. He had no way of knowing which route we had. Captain did not state our concern clearly enough: 'what's the plan for us?' the controller assumed we wanted higher. When given vectors then a radial intercept, we should have asked for an intended routing. Corrective actions: full route clrncs should be the norm. An SID for ric would eliminate the possible handoff miscom. Although we knew the MOA's were active, it was because of our inbound flight. Company WX and NOTAMS do not contain this information. That practice should be changed and VOR's and ATIS's within the vicinity of MOA's, etc, should broadcast their status.

THE FINAL INSTRUCTIONS WE RECEIVED AND ACKNOWLEDGED FROM RIC DEP WAS TO FLY AN 050 DEG HDG TO INTERCEPT THE RIC 074 DEG R. SHORTLY AFTER THAT, WE WERE TOLD TO CONTACT ZDC. AFTER CONTACT I TOLD THE CAPT THAT THE COURSE WE WERE ON WOULD TAKE US INTO THE RAPPA AND DELMAR MOA'S. CAPT THEN ASKED CTLR, 'WHAT'S THE PLAN FOR US?' THE CTLR RESPONDED HE WOULD HAVE HIGHER FOR US ASAP. (WE WERE LOWER THAN NORMAL AT THIS POINT, BUT WE WERE CONCERNED ABOUT THE MOA'S THAT WERE HOT 1 HR AGO). SHORTLY AFTER THAT THE CTLR NOTICED WE WERE IN THE R4006 AND INSTRUCTED US TO TURN 40 DEGS LEFT TO JOIN V33 AS ASSIGNED. THE CAPT TOLD THE CTLR THAT WE HAD NEVER BEEN ISSUED THAT CLRNC. THE CTLR'S INITIAL VECTOR WAS INADEQUATE TO JOIN THE ARWY. WE SPENT SEVERAL EXTRA MINS IN A HOT MOA WHILE EVERYTHING WAS SORTED OUT. CONTRIBUTING FACTORS: POOR COM IS THE #1 CAUSE HERE. THE CLRNC WAS GIVEN 'AS FILED.' THIS IS AN UNACCEPTABLE PRACTICE, ESPECIALLY IN HIGH DENSITY AREAS OR IN CLOSE PROX TO HOT AREAS. THE CLRNC DELIVERY PERSON MAY HAVE HAD OUR OLD FLT PLAN OF RIC 074 DEG R MODEL V33 COLIN, ETC, IN FRONT OF HIM. WE HAVE NO WAY OF KNOWING WHICH RTE HE HAD. HE HAD NO WAY OF KNOWING WHICH RTE WE HAD. CAPT DID NOT STATE OUR CONCERN CLEARLY ENOUGH: 'WHAT'S THE PLAN FOR US?' THE CTLR ASSUMED WE WANTED HIGHER. WHEN GIVEN VECTORS THEN A RADIAL INTERCEPT, WE SHOULD HAVE ASKED FOR AN INTENDED RTING. CORRECTIVE ACTIONS: FULL RTE CLRNCS SHOULD BE THE NORM. AN SID FOR RIC WOULD ELIMINATE THE POSSIBLE HDOF MISCOM. ALTHOUGH WE KNEW THE MOA'S WERE ACTIVE, IT WAS BECAUSE OF OUR INBND FLT. COMPANY WX AND NOTAMS DO NOT CONTAIN THIS INFO. THAT PRACTICE SHOULD BE CHANGED AND VOR'S AND ATIS'S WITHIN THE VICINITY OF MOA'S, ETC, SHOULD BROADCAST THEIR STATUS.
