Narrative:

This flight was an IFR competency check flight. My aircraft was vectored onto the ILS runway 25R at lvk by stockton approach. Lndgs were being made on runway 7L at lvk due to winds favoring this runway. The approach was to be made to circling minimums of 940' MSL. Just outside of reiga LOM we were handed off to lvk tower to stockton approach. During the procedure I was wearing a hood to simulate IFR conditions. My instrument was acting as safety pilot for the approach which was to be executed in VFR conditions. After handoff to lvk tower the lvk controller requested our position. We reported to be just outside of reiga LOM. The controller then requesting we report passing through 1700'. The approach was proceeding normally with my instrument asking questions on certain aspects of the procedure while monitoring the tower and watching for other traffic. There was another aircraft in the air traffic area talking to lvk tower with a similar sounding call sign. The lvk controller had several exchanges with this aircraft. As we passed through 1700' we reported to lvk tower. At this point the lvk controller asked how we wished to terminate the approach. A low approach with a turn out to the south was requested. The controller responded by requesting that we enter right traffic for runway 7L. We continued inbound and were nearing the 940' missed approach point for the circling approach when the controller requested we turn left immediately and enter right traffic for runway 7L. He then stated that we were to have turned before coming within 2 mi of the airport. We requested a departure to the south and left the air traffic area. The controller requested we contact him by phone. On the phone he reiterated that he had requested we turn our crosswind to enter right traffic for runway 7L 2 mi from the airport. At no time did either my instrument or I either hear or acknowledge the restriction. If the controller made the request it could have been mixed up with the aircraft with the similar call sign or covered up by a simultaneous transmission. To turn at 2 mi from the airport would have required input form my instrument since this is not a defined point on the approach. If the request was made by the controller for a turn at 2 mi we clearly missed it.

THE CTLR THEN REQUESTING WE RPT PASSING THROUGH 1700'. THERE WAS ANOTHER ACFT IN THE ATA TALKING TO LVK TWR WITH A SIMILAR SOUNDING CALL SIGN. THE LVK CTLR HAD SEVERAL EXCHANGES WITH THIS ACFT. AS WE PASSED THROUGH 1700' WE RPTED TO LVK TWR. AT THIS POINT THE LVK CTLR ASKED HOW WE WISHED TO TERMINATE THE APCH. A LOW APCH WITH A TURN OUT TO THE S WAS REQUESTED. THE CTLR RESPONDED BY REQUESTING THAT WE ENTER RIGHT TFC FOR RWY 7L. WE CONTINUED INBND AND WERE NEARING THE 940' MISSED APCH POINT FOR THE CIRCLING APCH WHEN THE CTLR REQUESTED WE TURN LEFT IMMEDIATELY AND ENTER RIGHT TFC FOR RWY 7L. HE THEN STATED THAT WE WERE TO HAVE TURNED BEFORE COMING WITHIN 2 MI OF THE ARPT. WE REQUESTED A DEP TO THE S AND LEFT THE ATA. THE CTLR REQUESTED WE CONTACT HIM BY PHONE. ON THE PHONE HE REITERATED THAT HE HAD REQUESTED WE TURN OUR XWIND TO ENTER RIGHT TFC FOR RWY 7L 2 MI FROM THE ARPT. AT NO TIME DID EITHER MY INSTR OR I EITHER HEAR OR ACKNOWLEDGE THE RESTRICTION. IF THE CTLR MADE THE REQUEST IT COULD HAVE BEEN MIXED UP WITH THE ACFT WITH THE SIMILAR CALL SIGN OR COVERED UP BY A SIMULTANEOUS XMISSION. TO TURN AT 2 MI FROM THE ARPT WOULD HAVE REQUIRED INPUT FORM MY INSTR SINCE THIS IS NOT A DEFINED POINT ON THE APCH. IF THE REQUEST WAS MADE BY THE CTLR FOR A TURN AT 2 MI WE CLEARLY MISSED IT.
