Narrative:

On departure from lga, during climb out to 15000', assigned heading 290 degrees, ATC advised of aircraft opp direction at our 11:30 position, 10000', and requested an expedite climb. We were VFR conditions, and visually acquired the aircraft (a foreign large transport Y) at less than 3 mi (estimated), and at our altitude. His position was not changing on the windscreen, but was getting larger, so I turned 30 degrees left to about 260 degrees, and the aircraft passed slightly below us (we were passing 10500' and slightly right, estimated 1/4 NM). Because we acquired the aircraft visually, and in time to maneuver away from his aircraft, we were able to avoid a much closer passing. Note: the controller had made several radio calls to the large transport Y aircraft west/O response before finally answering. While this was a close encounter, I choose not to think how close it might have been, had we been IFR and unable to fly an escape course.

Title: DEP CTLR CALLED TRAFFIC FOR LGT AND REQUESTED AN EXPEDITED CLIMB, BUT SEPARATION WAS LOST ANYWAY.

Narrative: ON DEP FROM LGA, DURING CLBOUT TO 15000', ASSIGNED HDG 290 DEGS, ATC ADVISED OF ACFT OPP DIRECTION AT OUR 11:30 POS, 10000', AND REQUESTED AN EXPEDITE CLB. WE WERE VFR CONDITIONS, AND VISUALLY ACQUIRED THE ACFT (A FOREIGN LGT Y) AT LESS THAN 3 MI (ESTIMATED), AND AT OUR ALT. HIS POS WAS NOT CHANGING ON THE WINDSCREEN, BUT WAS GETTING LARGER, SO I TURNED 30 DEGS LEFT TO ABOUT 260 DEGS, AND THE ACFT PASSED SLIGHTLY BELOW US (WE WERE PASSING 10500' AND SLIGHTLY RIGHT, ESTIMATED 1/4 NM). BECAUSE WE ACQUIRED THE ACFT VISUALLY, AND IN TIME TO MANEUVER AWAY FROM HIS ACFT, WE WERE ABLE TO AVOID A MUCH CLOSER PASSING. NOTE: THE CTLR HAD MADE SEVERAL RADIO CALLS TO THE LGT Y ACFT W/O RESPONSE BEFORE FINALLY ANSWERING. WHILE THIS WAS A CLOSE ENCOUNTER, I CHOOSE NOT TO THINK HOW CLOSE IT MIGHT HAVE BEEN, HAD WE BEEN IFR AND UNABLE TO FLY AN ESCAPE COURSE.
