Narrative:

Departed vny to crq after maintenance at vny. Aircraft was late from the facility and passenger were waiting at crq. I elected to depart vny west/O clearance, planning to contact approach control immediately after takeoff. I tried on several occasions to talk to bur approach, received no answer, switched from boom microphone to hand microphone, and by the time the controller answered, I had already climbed through and was clear of the arsa and eastbound out of 7500' MSL. Boom microphone (headset) was later found to be defective. I asked the controller for a phone # after he informed me I had violated the arsa west/O establishing 2-WAY communication, but he gave me a new frequency and no further mention was made by subsequent controllers. The whole problem could have been avoided by talking to vny clearance prior to departure and/or if the bur approach controller hadn't been on a landline. Callback conversation with reporter revealed the following: reporter states his intentions was to stay below floor of arsa at vny, contact bur approach, fly east until beyond or above TCA and then turned south. He was not aware of a letter from bur to the effect that they were maxed out and would no longer offer tower en route or pop up clrncs.

Title: CORP PLT FAILS TO MAKE CONTACT WITH BUR APCH PRIOR TO ENTRY OF ARSA.

Narrative: DEPARTED VNY TO CRQ AFTER MAINT AT VNY. ACFT WAS LATE FROM THE FAC AND PAX WERE WAITING AT CRQ. I ELECTED TO DEPART VNY W/O CLRNC, PLANNING TO CONTACT APCH CTL IMMEDIATELY AFTER TKOF. I TRIED ON SEVERAL OCCASIONS TO TALK TO BUR APCH, RECEIVED NO ANSWER, SWITCHED FROM BOOM MIC TO HAND MIC, AND BY THE TIME THE CTLR ANSWERED, I HAD ALREADY CLBED THROUGH AND WAS CLR OF THE ARSA AND EBND OUT OF 7500' MSL. BOOM MIC (HEADSET) WAS LATER FOUND TO BE DEFECTIVE. I ASKED THE CTLR FOR A PHONE # AFTER HE INFORMED ME I HAD VIOLATED THE ARSA W/O ESTABLISHING 2-WAY COM, BUT HE GAVE ME A NEW FREQ AND NO FURTHER MENTION WAS MADE BY SUBSEQUENT CTLRS. THE WHOLE PROB COULD HAVE BEEN AVOIDED BY TALKING TO VNY CLRNC PRIOR TO DEP AND/OR IF THE BUR APCH CTLR HADN'T BEEN ON A LANDLINE. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR STATES HIS INTENTIONS WAS TO STAY BELOW FLOOR OF ARSA AT VNY, CONTACT BUR APCH, FLY E UNTIL BEYOND OR ABOVE TCA AND THEN TURNED S. HE WAS NOT AWARE OF A LETTER FROM BUR TO THE EFFECT THAT THEY WERE MAXED OUT AND WOULD NO LONGER OFFER TWR ENRTE OR POP UP CLRNCS.
