Narrative:

Downwind departure from sjc continued climb approximately 100' into arsa before level altitude. Departure was to southeast, west of localizer. Tower-sjc-ask for my altitude, prior to which, on crosswind, I heard poor radio transmission from an experimental aircraft entering pattern. Exp crossed under me approximately 25' opposite tower as I turned to southeast from crosswind departure. This distraction of experimental (that apparently crossed VOR for pattern entry from the north) caused my distraction. I continued climb into arsa to 1600' before level flight.

Title: SMA PLT DEPARTING PATTERN DOWNWIND ENCOUNTERS ACFT ENTERING PATTERN. NMAC. DISTRACTED, PENETRATES FLOOR OF ARSA.

Narrative: DOWNWIND DEP FROM SJC CONTINUED CLIMB APPROX 100' INTO ARSA BEFORE LEVEL ALT. DEP WAS TO SE, W OF LOC. TWR-SJC-ASK FOR MY ALT, PRIOR TO WHICH, ON XWIND, I HEARD POOR RADIO XMISSION FROM AN EXPERIMENTAL ACFT ENTERING PATTERN. EXP CROSSED UNDER ME APPROX 25' OPPOSITE TWR AS I TURNED TO SE FROM XWIND DEP. THIS DISTR OF EXPERIMENTAL (THAT APPARENTLY CROSSED VOR FOR PATTERN ENTRY FROM THE N) CAUSED MY DISTR. I CONTINUED CLIMB INTO ARSA TO 1600' BEFORE LEVEL FLT.
