Narrative:

Taking off from newark. We flew the approximately SID, were told to contact center. He gave us a climb to FL230 and heading 310 degree for intercepting J-223 (322 right lga VOR). Next sector asked us what we were doing why weren't we on J-223? I told him that lga VOR was out of service, flags in view on VOR. He gave us direct elmira VOR. I asked how long lga was OTS, he said several months. It was not on my NOTAMS, further I just used lga VOR several days earlier. Just another failure of communication between ATC and the pilots. If lga isn't notamed OTS, we have not way of knowing and further the FAA flight plan had us filed on J-223 that uses lga 322 right to intercept elm 119 right.

Title: ACR FLT ON VECTOR TO INTERCEPT A CERTAIN RADIAL FLIES HEADING AND EXPERIENCES A TRACK DEVIATION FROM NOT MONITORING HIS RADIO NAVIGATION RECEIVER FOR PROPER SIGNAL RECEPTION. REPORTER CITES NOTAM SYSTEM AND ATC AS THE CAUSE.

Narrative: TAKING OFF FROM NEWARK. WE FLEW THE APPROX SID, WERE TOLD TO CONTACT CENTER. HE GAVE US A CLIMB TO FL230 AND HDG 310 DEG FOR INTERCEPTING J-223 (322 R LGA VOR). NEXT SECTOR ASKED US WHAT WE WERE DOING WHY WEREN'T WE ON J-223? I TOLD HIM THAT LGA VOR WAS OUT OF SERVICE, FLAGS IN VIEW ON VOR. HE GAVE US DIRECT ELMIRA VOR. I ASKED HOW LONG LGA WAS OTS, HE SAID SEVERAL MONTHS. IT WAS NOT ON MY NOTAMS, FURTHER I JUST USED LGA VOR SEVERAL DAYS EARLIER. JUST ANOTHER FAILURE OF COM BETWEEN ATC AND THE PLTS. IF LGA ISN'T NOTAMED OTS, WE HAVE NOT WAY OF KNOWING AND FURTHER THE FAA FLT PLAN HAD US FILED ON J-223 THAT USES LGA 322 R TO INTERCEPT ELM 119 R.
