Narrative:

On 9/89, at approximately mid pm, my student and myself went on a training flight consisting of conducting a simulated NDB approach off the local am radio station, and also conduct unusual altitudes and recoveries and steep turns. In approximately 30 mins, my student completed the approach and I then directed him to proceed to the designated practice area. I gave instruction in unusual attitude recovery and steep turns. After we had completed 3 unusual attitude recoveries and a partial steep turn, I took control of the aircraft from my student to avoid a midair collision with what appeared to be a small jet. After maneuvering the aircraft away from the small jet, I lost sight of it until it came extremely close to my aircraft again. Again I maneuvered my aircraft to avoid a possible midair collision. This occurred several more times. Then it appeared that the jet departed, so I proceeded back to our training base, cochise community college. During final approach to land, I received a radio call from us customs telling me to land and stay put. After I had landed my aircraft, again I received a radio call from us customs, telling me to simply call a phone # at customs and talk to the supervisor. After business hours, it is impossible for me to make a long distance phone call, so I went home to bisbee and proceeded to call the supervisor. During our conversation, he told me that I had committed an unspecified border incursion. He had also stated that he was very upset that I had left the aircraft. I then stated to him that I was directed to call him by us customs, and that I proceeded to do so by going home and doing so. He was also upset that I was apparently trying to evade a us customs jet, at the time of the encounter with the jet. I then returned to the airport and was met by a us customs military helicopter and us customs agents. I explained to them my situation and told them I did not, at any time, cross the us-mexican border, while trying to evade a us customs jet, but only trying to avoid possible midair collisions. I have not heard from us customs about this incident since I last talked to them on 9/tue/89.

Title: INSTRUCTOR PLT ON SMA TRAINING FLT ALLOWS ACFT TO CROSS OVER INTO MEXICO. PICKED UP BY BORDER PATROL ACFT.

Narrative: ON 9/89, AT APPROX MID PM, MY STUDENT AND MYSELF WENT ON A TRNING FLT CONSISTING OF CONDUCTING A SIMULATED NDB APCH OFF THE LCL AM RADIO STATION, AND ALSO CONDUCT UNUSUAL ALTS AND RECOVERIES AND STEEP TURNS. IN APPROX 30 MINS, MY STUDENT COMPLETED THE APCH AND I THEN DIRECTED HIM TO PROCEED TO THE DESIGNATED PRACTICE AREA. I GAVE INSTRUCTION IN UNUSUAL ATTITUDE RECOVERY AND STEEP TURNS. AFTER WE HAD COMPLETED 3 UNUSUAL ATTITUDE RECOVERIES AND A PARTIAL STEEP TURN, I TOOK CONTROL OF THE ACFT FROM MY STUDENT TO AVOID A MIDAIR COLLISION WITH WHAT APPEARED TO BE A SMALL JET. AFTER MANEUVERING THE ACFT AWAY FROM THE SMALL JET, I LOST SIGHT OF IT UNTIL IT CAME EXTREMELY CLOSE TO MY ACFT AGAIN. AGAIN I MANEUVERED MY ACFT TO AVOID A POSSIBLE MIDAIR COLLISION. THIS OCCURRED SEVERAL MORE TIMES. THEN IT APPEARED THAT THE JET DEPARTED, SO I PROCEEDED BACK TO OUR TRNING BASE, COCHISE COMMUNITY COLLEGE. DURING FINAL APCH TO LAND, I RECEIVED A RADIO CALL FROM U.S. CUSTOMS TELLING ME TO LAND AND STAY PUT. AFTER I HAD LANDED MY ACFT, AGAIN I RECEIVED A RADIO CALL FROM U.S. CUSTOMS, TELLING ME TO SIMPLY CALL A PHONE # AT CUSTOMS AND TALK TO THE SUPVR. AFTER BUSINESS HRS, IT IS IMPOSSIBLE FOR ME TO MAKE A LONG DISTANCE PHONE CALL, SO I WENT HOME TO BISBEE AND PROCEEDED TO CALL THE SUPVR. DURING OUR CONVERSATION, HE TOLD ME THAT I HAD COMMITTED AN UNSPECIFIED BORDER INCURSION. HE HAD ALSO STATED THAT HE WAS VERY UPSET THAT I HAD LEFT THE ACFT. I THEN STATED TO HIM THAT I WAS DIRECTED TO CALL HIM BY U.S. CUSTOMS, AND THAT I PROCEEDED TO DO SO BY GOING HOME AND DOING SO. HE WAS ALSO UPSET THAT I WAS APPARENTLY TRYING TO EVADE A U.S. CUSTOMS JET, AT THE TIME OF THE ENCOUNTER WITH THE JET. I THEN RETURNED TO THE ARPT AND WAS MET BY A U.S. CUSTOMS MIL HELI AND U.S. CUSTOMS AGENTS. I EXPLAINED TO THEM MY SITUATION AND TOLD THEM I DID NOT, AT ANY TIME, CROSS THE U.S.-MEXICAN BORDER, WHILE TRYING TO EVADE A U.S. CUSTOMS JET, BUT ONLY TRYING TO AVOID POSSIBLE MIDAIR COLLISIONS. I HAVE NOT HEARD FROM U.S. CUSTOMS ABOUT THIS INCIDENT SINCE I LAST TALKED TO THEM ON 9/TUE/89.
