Narrative:

When shooting a VOR a approach to san diego brown field we were cleared by san approach control for multiple approachs and, following the missed approach, to contact them on 119.6. When contacting brown tower at finle intersection and announcing intent to execute a missed approach and return for another VOR a approach, tower gave us the following. 'Approach control does not approve the missed approach, turn left and squawk 1200, remain clear of the TCA.' while involved in this communication, our call in, tower's reply, our query as to multiple approachs and tower's reply to again turn left and squawk 1200, is going on the approach was being continued. There was traffic in the 26R pattern and the minimum approach altitude of 1000' was nearing. We did execute a left turn and began a climb away from the pattern. We did come reasonably close, possibly within 1 mi, to a military helicopter which was practicing some kind of maneuver within the area of the sdm 26R landing pattern. It would seem more reasonable to me that if san approach control is to approve multiple approachs and does not want the published missed approach procedure followed they should include this in their communication. As this particular situation occurred we in the aircraft did not know exactly what our situation was and really what was intended for us. What finally evolved was that after making the left turn and climbing was again contacted approach control we were again accepted for multiple approachs by approach control. I feel that not only was the above setting up the possibility for a midair collision but also for an accidental incursion into the TCA.

Narrative: WHEN SHOOTING A VOR A APCH TO SAN DIEGO BROWN FIELD WE WERE CLRED BY SAN APCH CTL FOR MULTIPLE APCHS AND, FOLLOWING THE MISSED APCH, TO CONTACT THEM ON 119.6. WHILE INVOLVED IN THIS COM, OUR CALL IN, TWR'S REPLY, OUR QUERY AS TO MULTIPLE APCHS AND TWR'S REPLY TO AGAIN TURN LEFT AND SQUAWK 1200, IS GOING ON THE APCH WAS BEING CONTINUED. THERE WAS TFC IN THE 26R PATTERN AND THE MINIMUM APCH ALT OF 1000' WAS NEARING. WE DID EXECUTE A LEFT TURN AND BEGAN A CLB AWAY FROM THE PATTERN. WE DID COME REASONABLY CLOSE, POSSIBLY WITHIN 1 MI, TO A MIL HELI WHICH WAS PRACTICING SOME KIND OF MANEUVER WITHIN THE AREA OF THE SDM 26R LNDG PATTERN. IT WOULD SEEM MORE REASONABLE TO ME THAT IF SAN APCH CTL IS TO APPROVE MULTIPLE APCHS AND DOES NOT WANT THE PUBLISHED MISSED APCH PROC FOLLOWED THEY SHOULD INCLUDE THIS IN THEIR COM. AS THIS PARTICULAR SITUATION OCCURRED WE IN THE ACFT DID NOT KNOW EXACTLY WHAT OUR SITUATION WAS AND REALLY WHAT WAS INTENDED FOR US. WHAT FINALLY EVOLVED WAS THAT AFTER MAKING THE LEFT TURN AND CLBING WAS AGAIN CONTACTED APCH CTL WE WERE AGAIN ACCEPTED FOR MULTIPLE APCHS BY APCH CTL. I FEEL THAT NOT ONLY WAS THE ABOVE SETTING UP THE POSSIBILITY FOR A MIDAIR COLLISION BUT ALSO FOR AN ACCIDENTAL INCURSION INTO THE TCA.
