Narrative:

Flight sfo to oak I was captain and flying pilot. Oak was 6 broken 10. I was cleared for ILS 29 to oak on localizer on G/south. About 8 DME, handed off from bay approach to oak tower. Oak tower issued a traffic alert, at about 7 DME. My copilot saw an small transport below us in a left climbing turn, approximately 100-200' below us. Oak tower says they saw the traffic pop off with an IFR code?? I don't think the small transport was VFR. I don't know if he was given a clearance into my airspace or not?
