Narrative:

The pilot flying the small aircraft was at an improper altitude. He should be advised to abide by the hemispherical flight rule as stated in far 91. I was flying level on a commuter flight from kenai to anchorage. I was flying on the ena 020 degree right at an altitude of 3500'. I was adjusting my radios to receive anc ATIS when I observed an airplane approaching me head on at my altitude. I began an immediate bank to the right not exceeding 40 degrees of bank. I turned approximately 30 degrees to the right. The small aircraft saw me at the last second because I saw him bank as he went by me. 2 related factors in this incident were pilot of the small aircraft was at an improper altitude for the course he was flying, and my attention for a few seconds was tuning in my receiver to receive anc ATIS before switching to approach control.

Title: CLOSE PROX COMMUTER-SMT GA-SMA NEAR V334 SOUTH OF ANC.

Narrative: THE PLT FLYING THE SMA WAS AT AN IMPROPER ALT. HE SHOULD BE ADVISED TO ABIDE BY THE HEMISPHERICAL FLT RULE AS STATED IN FAR 91. I WAS FLYING LEVEL ON A COMMUTER FLT FROM KENAI TO ANCHORAGE. I WAS FLYING ON THE ENA 020 DEG R AT AN ALT OF 3500'. I WAS ADJUSTING MY RADIOS TO RECEIVE ANC ATIS WHEN I OBSERVED AN AIRPLANE APCHING ME HEAD ON AT MY ALT. I BEGAN AN IMMEDIATE BANK TO THE RIGHT NOT EXCEEDING 40 DEGS OF BANK. I TURNED APPROX 30 DEGS TO THE RIGHT. THE SMA SAW ME AT THE LAST SECOND BECAUSE I SAW HIM BANK AS HE WENT BY ME. 2 RELATED FACTORS IN THIS INCIDENT WERE PLT OF THE SMA WAS AT AN IMPROPER ALT FOR THE COURSE HE WAS FLYING, AND MY ATTN FOR A FEW SECS WAS TUNING IN MY RECEIVER TO RECEIVE ANC ATIS BEFORE SWITCHING TO APCH CTL.
